Salvation Army Elites Turn Left December 6, 2021 Catholic League president Bill Donohue comments on his report on The Salvation Army: The Catholic League’s headquarters is located directly across the street from Penn Station and Macy’s in New York City. Every Christmas season we look forward to The Salvation Army men and women in uniform ringing their bells, and often dancing to Christmas music, aside their red kettles, collecting money for the needy. Unfortunately, there have been some organizational changes that are giving lots of people pause this Christmas season. As always, it is the elites who are the problem. The average volunteer is just as good as ever, doing God’s work. Earlier this year, the International Salvation Army issued a lengthy report, “Let’s Talk About Racism,” that is aimed at everyone associated with the organization. It is meant as a discussion guide. Part of it is commendable: Scripture is frequently cited on the need to treat everyone equally, regardless of race. But it is interposed with the same kind of critical race theory polemics that is cause for concern all across the nation. Instead of combating racism, it is unwittingly contributing to it. The report is no longer available on the internet, but we obtained a copybefore it was taken down by The Salvation Army. It was taken down because of the backlash the report engendered. On Thanksgiving Day, the top brass issued a statement, “The Salvation Army’s Response to False Claims on the Topic of Racism.” This was simply dishonest. Instead of apologizing for adopting the politics of the hard-core left, the elites doubled down by lashing out at its critics. “They [the critics] have claimed that we believe our donors should apologize for their skin color, that The Salvation Army believes America is an inherently racist society, and that we have abandoned our Christian faith for one ideology or another. Those claims are simply false, and they distort the very goal of our work.” Not so fast. In the Introduction to the report, on p. 3, advice is given to their flock, or what they call Salvationists. One of the items suggest that they “Lament, repent and apologize for biases or racist ideologies held and actions committed (my italic).” This is more than an assumption: throughout the document, as will be detailed, the understanding is that white people are racists, thus necessitating the need to “apologize.” It is similarly disingenuous to say that the critics are wrong when they say that “The Salvation Army believes America is an inherently racist society.” On p. 3 in Appendix D, it explicitly says of America that “Our foundations were built on racism, and it is still strongly felt in every aspect of American life.” There is no other way to read that other than to say that “America is an inherently racist society.” While it would be unfair to say The Salvation Army has “abandoned [its] Christian faith for one ideology or another,” it is true that its deep dive into critical race theory has created several blind spots. For example, on p. 1, Appendix A, it offers a morally neutral interpretation of the Affordable Care Act. One would think that a Christian organization would at least mention, if not condemn, the ObamaCare healthcare mandate forcing religious nonprofits, such as the Little Sisters of the Poor, to include abortion-inducing drugs in their healthcare plan. But there is no such mention. It is abundantly clear that the authors of this report are generally ignorant of both the natural and social sciences. Indeed, it reads like a tract, not a document informed by science. On p. 2 of the Introduction, it says race and racism “have no basis in science or biblical thought.” On p. 2 of Session One, it says, “Race is not biological. It is a social construct.” It would be more accurate to say that the consensus in scientific circles is that the term race has both genetic and environmental roots. A.L. Kroeber, the distinguished cultural anthropologist, was clearly aligned with those who emphasize nurture over nature, yet even he admitted that “race is a valid biological concept.” Furthermore, he studied under the early 20th century anthropologist Franz Boas, who, while adhering to a belief in cultural relativism, nonetheless said that race was “a scientific concept [that] applies only to the biological groupings of human types.” If race were purely a social construct, why is it that racial groups differ widely on their susceptibility to certain diseases? There is more at work than mere environmental matters when we learn that sickle-cell anemia is more prevalent among African Americans than it is whites. Why is it that this disease affects 1 in 13 African Americans but only 1 in 100 Hispanic Americans? Sickle-cell anemia is a function of hemoglobin A (HbA), the usual form of hemoglobin, and hemoglobin S (HbS), a variant group. Is hemoglobin a social construct? If it were, then why in my doctoral training in sociology was hemoglobin never mentioned? A more honest approach, to cite one example, is found in an article in the October 26, 2020 medical publication, Stroke. “Identifying Genetic and Biological Determinants of Race-Ethnic Disparities in Stroke in the United States” was authored by five men and women who hold PhDs and MDs. One of their conclusions gets directly to my point. “Although the Black-White disparities in stroke have been known for at least a half century,” they write, “only recently have studies focused on biological and genetic factors that contribute to racial disparities in stroke.” In other words, the notion that race is nothing more than a social construct is plainly false. In the Introduction, the term racism is given a fairly standard definition, but on p. 3, Session One, the report slides into politics. Racism is defined as “The prejudiced treatment, stereotyping or discrimination of POC [People Of Color] on the basis of race.” If a sociology student of mine were to offer this definition, he would fail. Since when does racism apply only to “People Of Color”? According to this definition, “People Of Color” are incapable of being racists. That would mean that Louis Farrakhan, the notorious black anti-Semite, is not a racist. No one believes this save those drunk on ideology. The world is not divided between white racists and their victims. Indeed, to imply as such is a prime example of racism. Furthermore, the term “People Of Color” is meaningless. Asians are at the top of the educational and socio-economic scale, and African Americans are at the bottom. So what exactly do they have in common? That they are not white? On p. 5 of the Glossary we learn that a racist is “a person who belongs to a dominant or privileged group that discriminates against people of other races, or someone who believes that a particular race is superior to another.” The latter part is true, but it is absurd to imply that a person cannot be a racist unless he belongs to “a dominant or privileged group.” Lori Lightfoot is the black mayor of Chicago and she expressly said in July 2021 that she would not grant interviews to white reporters (she rescinded the rule two days later amid a backlash). What she did was racist, and there is no getting around it. She discriminated against white reporters. It is ironic to note that this report, which was written to combat racism, smacks of racism. The bias against white people is palpable. “Whiteness and White racialized identity refer to the way that White people, their customs, culture and beliefs operate as the standard by which all other groups are compared.” That is what it says on p. 6 of the Glossary. This is a prime example of racism. Not only is “Whiteness” a contrived slang term designed to denigrate all Caucasians, there is no such thing as white “customs, culture and beliefs.” The customs, culture and beliefs of the Irish are not that of the Ukrainians. For that matter, it is racist to assume that the Chinese and Japanese share the same customs, culture and beliefs. They manifestly do not. One of the biggest problems with this report—another clear reflection of critical race theory—is the propensity to see racism everywhere. On p. 3, Session 4, it labels as an example of “racial inequities” the fact that more blacks have died of COVID-19 more than whites. One reason for this disparity is that the obesity rate among whites is 30.2% and among blacks it is 35.9%. This matters because there is a positive correlation between obesity and COVID-19, meaning the more obese someone is the more likely he is to get the disease. Similarly, on p. 3, Session 2, the report offers as an example of racism the fact that blacks are much more likely to be incarcerated than whites, and that they don’t do nearly as well in school. There is a reason for this: blacks commit a disproportionate amount of violent crimes and they test at the bottom in tests measuring educational achievement. Lest someone think I am implying that blacks are naturally given to crime, or that they are not as intelligent as whites, let me hasten to add that that is not what I mean. Both conditions are easily explainable, and they have nothing to do with race. It is the family that matters, not race. Men of any race who come from fatherless families are much more likely to be involved in crime, and students who are raised in one-parent families generally do not do as well in school as those raised in two-parent families. For reasons tied to public policies that have undermined the black family—policies advocated by the “anti-racists”—most black kids are raised in female-headed households. On p. 3, Session 4, the report lists George Floyd as a victim of police brutality, and on p. 1 Appendix C it lists Michael Brown and Eric Garner (as well as three largely unknown persons) as victims of police racism. Yet in each case there were factors having nothing to do with race that led to their deaths. In the case of Brown, it has been proven beyond a reasonable doubt that the police did nothing wrong. Even the Obama administration’s Department of Justice came to this conclusion. It is clear that the authors are in over their heads. On p. 4, Session 5, they say that it is a problem when people do not intermix with those of different cultural and ethnic backgrounds. This is astonishing. They have just unwittingly condemned the Chinese. Wherever they live, they choose to live in “Chinatowns” (quite unlike the Japanese who assimilate). Does this make them racists? If this isn’t bad enough, the report ends with a list of recommended books on the subject of combating racism, many of which actually promote the very racist ideas that this document promotes. The Salvation Army elites have done a disservice to this great organization. They need to do more than withdraw this dreadful report: They need to make a public statement apologizing for the damage they have done to the status of the organization and a pledge never again to succumb to left-wing politics. The COVID-19 pandemic has been one of fear, manufactured by individuals who were in the nominal positions of authority as the virus began to spread across the globe last year, according to Yale epidemiologist Dr. Harvey Risch.

In an appearance on EpochTV’s “American Thought Leaders” program, Risch, an epidemiology professor at the Yale School of Public Health and Yale School of Medicine’s Department of Epidemiology and Public Health, argued that by and large, what has characterized the entire CCP (Chinese Communist Party) virus pandemic has been a “degree of fear and people’s response to the fear.”

“Overall, I’d say that we’ve had a pandemic of fear. And fear has affected almost everybody, whereas the infection has affected relatively few,” said Risch.

“By and large, it’s been a very selected pandemic, and predictable. It was very distinguished between young versus old, healthy versus chronic disease people. So we quickly learned who was at risk for the pandemic and who wasn’t,” he added.

“However, the fear was manufactured for everybody. And that’s what’s characterized the whole pandemic is that degree of fear and people’s response to the fear.”

The epidemiology professor suggested that individuals who held the nominal positions of authority during the onset of the pandemic in March 2020 initially spread a much worse picture of the “dire nature” of the virus than was warranted.

That included the message that everybody was at risk, everybody could die from contracting the virus, everybody needed to find protection, everybody needed to stay in their homes and not socialize with others to protect themselves, and in this way protect society, Risch explained.

“People were quite afraid of that message, as anybody would be…with the government, with authorities, with scientists, scientific people, with medical people in authority in the public health institutions, all saying the same message starting in about, February, March of last year. And so we all kind of believe this,” he said.

In the first two months of the pandemic, stringent lockdowns and mask mandates were implemented to curb the transmission of COVID-19 in the United States and across the globe. Risch said that the types of messages issued by authorities led to widespread heightened anxiety levels.

“All of our anxiety levels were raised, and we all made decisions to curtail, to various degrees, our exposures to other people, some more than others, but I think everybody had levels of anxiety that really affected how they carry out their life at that time,” he said.

Meanwhile, President Joe Biden has said that 96 to 98 percent of Americans need to be vaccinated against COVID-19 before the nation can “go back to normal,” pushing the rhetoric that unvaccinated Americans are to blame for slowing down the nation’s economic recovery.

According to data by the U.S. Centers for Disease Control and Prevention, as of Dec. 4, just over 70 percent of American adults are fully vaccinated against the virus, while 23.9 percent have received a booster dose.

And how did we arrive at a situation where the purported leader of our country, Joe Biden, himself jokingly declares that the president is Anthony Fauci, the principal architect of our current COVID tyranny? How, in short, did we reach a point where freedom and individual liberty are completely subordinate to the dictates of a bureaucracy? These are questions that writers here at American Greatness have been asking for some time, most recently eloquently posed by Anthony Esolen and Glenn Ellmers.Could there be a clue provided by the surprising comments from Supreme Court Justice Sonya Sotomayor, in the arguments last week over Mississippi’s recent abortion restrictions? The justice remarked to the lawyer defending the statute, “The issue of when life begins has been hotly debated by philosophers since the beginning of time. It’s still debated in religions. So, when you say this [the purported constitutional right to a pre-viability abortion] is the only right that takes away from the state the ability to protect a life, that’s a religious view, isn’t it?”  Sotomayor’s views on abortion were the subject of withering criticism from, among others, George Washington University Law Professor Jonathan Turley (my former student, of whom I am well pleased), principally because there is no good constitutional defense of Roe v. Wade’s holding that terminating a pregnancy is a constitutionally protected right. But most revealing and most troubling is Sotomayor’s implication that Mississippi’s statute would be constitutionally suspect if it had a religious basis.The justice and, one suspects, many if not most contemporary liberal lawyers probably now believe that no state or federal government may make legislative decisions based on a religious foundation because the prevailing interpretation of the First Amendment’s religious establishment clause is that neutrality on religion must be enforced by the court.This notion has permeated our culture, first through the Supreme Court’s decisions in the 1960s prohibiting compulsory prayer or Bible-reading in the public schools, and most recently through the court’s similarly barring school-sponsored prayer at graduation ceremonies or football games, as well as prohibiting the display of the Ten Commandments in some courthouses, and of crosses on municipal seals. Serious students of the 18th and 19th century understandings of the First Amendment know that this is a wrong turn in interpretation, and that originally the consensus view was that earliest expressed by John Jay in Federalist 2 that Americans shared the same religion (Christianity), or by John Adams that our Constitution was made only for a moral and religious people, or by Joseph Story that it was the job of all our governments, including the federal one, to promote Christianity.Following religious persecution by Nazi Germany, of course, it became more common to fear that any privileging of one religion over another, or any denigration of any particular religious practicem, risked tyranny. But perhaps we should now recognize that in forgetting the framers’ basic lesson that there can be no order without law, no law without morality, and no morality without religion, we have taken a turn for the worse. The clear assumption of the bureaucrats who have injured freedom in pursuit of protecting us from a virus that, for most of the American population, does not pose a serious danger is that the prevention and control of disease is legitimately a paramount goal of public policy, and that individual autonomy must be sacrificed pursuant to this greater good.  As Fauci himself recently explained itI think each of us, particularly in the context of a pandemic that’s killing millions of people, you have got to look at it and say there comes a time when you do have to give up what you consider your individual right of making your own decision, for the greater good of society.For Fauci, then, constitutional rights are subordinate to the bureaucracy’s decisions about what is best for the nation.The framer’s conception appears to be something quite different. In order to understand this, one has to come seriously to grips with what the implementation of Jay’s, of Adams’, and of Story’s views would be. If the United States truly were a Christian nation, then the primary obligation of the citizens of our polity would be to follow the teachings of the New Testament, and most prominently the Gospels. While it would take a lifetime of study to capture all of the nuances of scripture, we can certainly limn a few of them.First, the most important goal of the polity would be to glorify the Creator, humbly to acknowledge the greatness of creation and the sovereignty of the power of the Deity. Odd as this sounds to our ears, it was not so long ago that even an Ivy Leaguer could routinely declare that what should be done was done for “God, for country, and for Yale.” To make the point slightly differently, our current COVID policy (and one is tempted to say virtually all of the activities of the federal government) assumes that all there is, is the here and now, and the best we can ever do or ever achieve is to promote our creature comforts and satisfy our material concerns. The lesson of the Gospels, though, and particularly of John (in marked similarity to Plato, among some other ancients) is that this material world is not all there is, and that the highest and best task for humankind is to seek eternal life and spiritual well-being, through love of each other and of our Maker.The spirit-crushing mask mandates and lockdowns, which deprived so many school children and their elderly relatives of the joy of human affection and human contact, we may eventually realize, actually cost us much more than the benefits they secured.According to the Gospels, it would appear, security is not the goal of existence, rather worship, love, and charity are. Loving others also implies allowing them to choose between good and evil, and this is why Christianity has been seen by some of our wisest political commentators as demanding and ensuring a maximum of human freedom. The Gospels make clear that we are to render unto Caesar what is Caesar’s and to God what is God’s. But Caesar doesn’t get everything, and his jurisdiction is thus subject to limits. This is the same basic principle of limiting arbitrary power that is the essence of our Constitution, and we have cause to wonder whether many in the federal government, and Anthony Fauci in particular, understand this.The most basic governmental insight of our framers was probably the ubiquity and inevitability of corruption, certainly rife in the world of the New Testament among the Pharisees and Romans and rampant in late 18th-century Britain. When the English authorities in the Board of Trade and the Ministry went too far in the late 18th century, American independence and the Revolution ensued.Our federal government now appears to be suffering from an unparalleled arrogance and corruption of its own, and many of our state governments appear unable or unwilling to carry out the measures necessary to secure law and order, to say nothing of spiritual well-being. Many of us even doubt whether we still have free and fair elections. With liberty endangered, with corruption and incompetence rampant, we can only hope and pray for a spiritual renewal that might enable us to reject Justice Sotomayor’s pernicious “neutrality,” to return religion to its rightful place in our polity, and to escape our current risks of tyranny, anarchy, or revolution.

White House Releases Test Results After Biden’s Health Concerns Americans

President Biden sounded odd at his press conference on Friday — in more ways than one. After discussing the recent “disappointing” jobs report, Fox News’ Peter Doocy asked him about his voice sounding “different.”

“Your voice sounds a little different. Are you OK?” Doocy asked.

“I’m OK … What I have is a 1 1/2-year-old grandson who had a cold who likes to kiss his Pop,” Biden answered.

The president’s response did not exactly reassure the American people about his state of health.

On Thursday, President Biden addressed the nation about the currently minor Omicron variant and the actions his administration is taking to fight it.

While discussing what he called “surge response teams,” Biden repeatedly slurred his words, coughed, and generally sounded ‘out of it.’

But even more concerning, Biden has said he would do ‘everything in his power’ to ensure children get vaccines for Covid, despite not knowing if they are safe, as well as that they do little to stop the spread of the variants.

Shortly after his remarks on Friday, Biden’s White House physician released negative test results for Covid-19. The doctor did say that the president is taking ivermectin cold medicine.

Prosecutors who won’t prosecute the ‘wrong’ people for their crimes and prosecutors hell-bent on prosecuting the ‘right’ people for what they symbolize.

There is a flip side to the way progressives have perverted the concept of prosecuting crime. It is, in its way, just as insidious as the now-familiar delirium that non-prosecution is the best prosecution.

The flip side is equally the fallout of politicizing state police power. It flows naturally from the conceit that the point of prosecution is to run interference for the Left’s favored groups while penalizing those who oppose progressives. It has only disdain for the quaint idea that we prosecute to uphold the rule of law, so society as a whole can flourish.

The flip side is this: When today’s cutting-edge prosecutors do deign to prosecute, the target is ideas, not acts. The objective is not to neutralize those who prey on society but to frame their acts as part of a morality play: the progressives cast as the guardians of “our values,” and the criminals drawing out contempt more for what motivates them — or, at least, what progressives say motivates them — than for any evil they have done.

This is exemplified by the Kyle Rittenhouse prosecution.

The fact that Rittenhouse, then 17 years old, shot and killed people was not decisive in making his prosecution a national story. More people are routinely shot in Chicago than were shot in Kenosha on that fateful night. And, though not as sedulously suppressed as news of black-on-black violence is, white-on-white violence is usually far too humdrum for the media-Democrat complex to take much notice.

Rittenhouse was prosecuted not for what he did but for what he represented: a white, non-woke, police-supporting teenager exploiting his Second Amendment right to bear arms and his underlying natural right to use his rifle in self-defense. Worse, he engaged in social-justice interruptus. By contrast, the acts of rioters who violently burned down the town were deemed irrelevant, even benign, by the Powers that Be. After all, they rioted in the holy cause of opposing police who shoot knife-wielding, arrest-resisting felons who happen to be black. It is Rittenhouse — the symbol, not the actor — who matters.

In the morality play, then, Rittenhouse occupied the villain role of white supremacism (of which police are ordinarily cast as the point of the spear). We were to see his attackers, the white left-wing radicals on whom he fired, as not merely honorary oppressed black men but as if they actually were oppressed black men.

You think I’m kidding? Well, Congressman Jerry Nadler, the hack chairman of the House Judiciary Committee (and a New York Democrat who used to pose as a civil-liberties stalwart when the rights of jihadist terrorists were the Left’s cause célèbre) is urging the Justice Department to indict Rittenhouse on civil-rights charges. In this context, that would make sense only if the shootings were motivated by racism — since Nadler’s theory that Rittenhouse was “targeting” protesters’ enjoyment of their First Amendment rights was rejected by jurors who unanimously found that he acted in self-defense (i.e., Rittenhouse was the targetee.)

Happily, for the progressive ideologues running the Biden Justice Department, they have no such problem with the three killers of Ahmaud Arbery. He was a young black man, and the killers are white — easily limned as good ol’ boys from the Deep South. So, in their case, DOJ has brought the civil-rights indictment that Nadler seeks for Rittenhouse.

The state of Georgia convicted Arbery’s killers — the father and son Greg and Travis McMichael, along with their neighbor and accomplice, William “Roddy” Bryan — despite the absence of evidence that Arbery was killed because of his race. Rather, although the three defendants rationally suspected Arbery of stealing property from a construction site, they were found guilty because they wrongly supposed their suspicion rose to the level of probable cause to make a citizen’s arrest. This egregious error rendered criminal — assault, false imprisonment, and murder — their forcible apprehension of Arbery and their use of lethal force when he resisted.

So, can you really blame Nadler for thinking Biden’s Justice Department might be willing to haul Rittenhouse into the federal dock? DOJ is proceeding against Arbery’s killers even though there is no reason to do so, given that they are all looking at likely sentences of life imprisonment. Worse, to convict the McMichaels and Bryan of the civil-rights felonies charged, the feds would have to establish beyond a reasonable doubt something Georgia did not even try to show — that it’s all about racism. Nadler has obviously deduced that pointlessness and lack of evidence do not dissuade this Justice Department when there is an opportunity to advance the partisan morality play.

Meanwhile, the suburbs of Milwaukee and Detroit both endured horrific mass-murder attacks around Thanksgiving. In Waukesha, Wis., career criminal Darrell Brooks Jr. allegedly killed six people and injured dozens of others, many very seriously, when he raced his SUV through an annual parade. In Oxford, Mich., a tormented 15-year-old named Ethan Crumbley allegedly shot up his high school, killing four students between the ages of 14 and 17 and wounding seven others.

To describe these incidents as atrocious does not begin to do them justice. But let’s try to be clinical for a moment. As egregious as these crimes are, they are just as easy for prosecutors to prove — to convict on straightforward crimes that carry crushing sentences.

These are situations in which there is no doubt about what happened and who did it. By themselves, the murder counts will call for multiple life-imprisonment sentences (with the state having already announced that Crumbley will be treated as an adult for prosecution purposes). If we add in the charges of attempted murder, maiming, and criminal assault (as well as firearms-use charges against Crumbley), we are talking about decades upon decades of additional prison terms. Brooks and Crumbley could live multiple lives apiece and not survive long enough to complete the terms of incarceration that stand, quite justly, to be imposed on them.

Yet, in both cases, prosecutors are not content to charge the crimes that happened. They are going for a crime that didn’t happen — terrorism. It is reportedly being weighed in Brooks’s case, and a terrorism charge already has been lodged against Crumbley.

In a column on Friday, I explained why the Oxford High School mass-murder attack, though atrocious, was not a terrorist attack. 

The Wisconsin terrorism law is potentially more expansive than Michigan’s, but Brooks did not commit a crime of terrorism, either. We can’t charge heinous acts as terrorism just because, in a colloquial sense, they are terrifying. To make sense as a crime of terrorism, an attack has to be directed at the society qua society, or at its government in an effort to extort policy changes or other concessions.

Violent attacks that involve large-scale taking of life do not qualify as terrorism in the absence of this motivation. That is why terrorism charges are generally reserved for operatives of foreign or domestic terrorist organizations capable of projecting power over time and space. And, as I also noted Friday, when the incumbent president was vice president for eight years, the administration resisted labeling even patent jihadist attacks as terrorism. Obama/Biden officials rationalized that merely being “inspired” by such organizations as al-Qaeda and ISIS was not good enough; there had to be evidence of membership in, or at least operational direction by, a government-recognized terrorist  organization.

Brooks and Crumbley are not terrorists. They appear to be cold-blooded murderers. That is plenty bad enough. The instinct to brand them as “terrorists” is political, not legal. In Brooks’s case, perhaps it’s to preen that he is now being taken seriously, in hopes that you don’t remember that prosecutors released him again and again to prey on the streets, despite his 20 years of committing felony after violent felony. In Crumbley’s case, the overreach is transparently part of the progressive crusade against gun rights. It’s the same politics that fueled the Rittenhouse prosecution. It’s the same politics that have led prosecutors to indict Crumbley’s parents for involuntary manslaughter: potentially 15 years’ imprisonment for failing to lock up a gun, which is not a crime in Michigan, however irresponsible it was under the circumstances.

In sum, we have prosecutors who won’t prosecute the “wrong” people for their crimes, and prosecutors hell-bent on prosecuting the “right” people for what they symbolize. They tend to be the same prosecutors. And unlike rule-of-law prosecutors, what moves them is not evidence.

Justice Thomas Sinks Pro-Abortion Lawyers with One Simple Question

The Supreme Court heard the oral arguments Wednesday in Dobbs v. Jackson’s Women’s Health Organization.

This case has the potential to overturn the Court’s precedential cases Roe v. Wade and Planned Parenthood v. Casey, which say that women have the right to abort their babies up to about 24 weeks of pregnancy.

Mississippi law bans nearly all abortions after 15 weeks of pregnancy. The case heard this week challenges that law.

After 24 weeks, a fetus is typically considered viable (able to survive outside the womb), so the law deems it is no longer able to be aborted.

The arguments for Jackson’s Women’s Health Organization rested heavily upon the idea that abortion is a question of right, liberty and autonomy, and for those reasons, it must be upheld. But Justice Clarence Thomas questioned whether abortion is a constitutional right.

Julie Rikelman addressed the court on behalf of Jackson Women’s Health Organization, which is the last abortion clinic in Mississippi, along with U.S. Solicitor General Elizabeth Prelogar, who argued, “If this Court renounces the liberty interests recognized in Roe and reaffirmed in Casey, it would be an unprecedented contraction of individual rights and a stark departure from principles of stare decisis [precedent].

Prelogar added, “The Court has never revoked a right that is so fundamental to so many Americans and so central to their ability to participate fully and equally in society. The Court should not overrule this central component of women’s liberty.”

Thomas then immediately asked Prelogar to clarify exactly what right was being argued for.

“General, would you specifically tell me — specifically state what the right is? Is it specifically abortion? Is it liberty? Is it autonomy? Is it privacy?” Thomas asked.

Prelogar answered that the right to abortion was on the basis of liberty, found in the fourteenth amendment, as well as autonomy and privacy.

Justice Thomas responded by asking a further clarifying question, which seemed to be aimed at questioning the constitutional precedent and “right” that was being assumed.

“I understand we’re talking about abortion here, but what is confusing is that we — if we were talking about the Second Amendment, I know exactly what we’re talking about. If we’re talking about the Fourth Amendment, I know what we’re talking about because it’s written. It’s there. What specifically is the right here that we’re talking about?” Thomas said.

Mississippi’s state solicitor general, Scott Stewart, who represented for Dobbs, had already argued that Roe and Casey did not, in fact have constitutional grounding.

“Mr. Chief Justice, and may it please the Court: Roe versus Wade and Planned Parenthood versus Casey haunt our country. They have no basis in the Constitution,” Stewart said.

Stewart also argued that, based on previous Supreme Court precedent, assuming a right simply based on privacy and autonomy was not how the Court operated.

“Yes, the Constitution does provide certain — protect certain aspects of privacy, of autonomy, and the like, but, as this Court said in Glucksberg, going directly from general concepts of autonomy, of privacy, of bodily integrity, to — to a right is not how we traditionally, this Court traditionally, does due process analysis,” Stewart said.

That seems to be the heart of the issue and that is what Thomas was getting at in his questioning. It’s not just a question of whether there is a right to abortion, but whether that right first comes from a Constitutional right to certain bodily autonomy.

“I am trying to look at the issue of bodily autonomy and whether or not she has a right also to bodily autonomy in the case of ingesting an illegal substance and causing harm to a pre-viability fetus,” Thomas told Rikelman.

Of all the current Supreme Court Justices, Justice Clarence Thomas has been on the court the longest. He took his seat in 1991.

It is assumed that Thomas will be in favor of upholding the Mississippi law, SCOTUS Blog reported.

He was on the Court for the Casey ruling in 1992 and joined the opinion of previous Chief Justice William Rehnquist, saying, “Roe was wrongly decided, and … it can and should be overruled.”

But his distinctive questioning Wednesday made an important clarification in the debate over abortion: The choice to abort a baby is not, in and of itself, a Constitutional right. But the Constitution does uphold the rights to liberty and it promotes certain ideas of autonomy. So does abortion fall under that constitutional umbrella of liberty, specifically laid out in the fourteenth amendment?

That is what Justice Thomas was trying to clarify. Rorate Caeli presented a translation of the November 30 Charlier article from the German website Motu proprio: Summorum Pontificum that they titled Ex-Ecclesia Dei Communities Facing a Decision(source). It is summed up by the above Gloria.tv’s post and concludes apparently saying resistance to this betrayal of Pope Benedict XVI’s act of religious freedom for Traditionalist Catholics is “schismatic “:

The theologian Dr. Peter Kwasniewski says that Charlier said to him it will “make a smooth transition to the NO”:

TC alleges all TLM-exclusive clergy to be illoyal to “THE COUNCIL”—thus conveniently equating the Council and the “spirit of the Council” as seen by Bugnini and his followers up to Archbishop Roche. The betrayal of the Chinese Church can thus be called the Francis/Parolin deal.

The Francis/Parolin deal is a abuse of papal power which can be disobeyed in good conscience as shown by the saintly English Bishop Robert Grosseteste.

In 1253, Bishop Grosseteste disobeyed Pope lnnocent IV who ordered that a benefice within his jurisdiction be given to the papal nephew. Benefices were a form of financial exploitation given to prelates who didn’t reside in the diocese and never saw their flock so souls were lost for lack of true shepherding or pastoral care.

Grosseteste said that benefices have only one end: “the salvation of souls.” Exploitative use of benefices was a abuse of papal power so he disobeyed Pope Innocent IV.

Innocent reportedly raged in anger, but his advisors told him to back down because all of Christendom knew Bishop Grosseteste was “one of the most learned men” of the age and a saintly bishop.

The Catholic Encyclopedia said of Grosseteste:

“Bishop of Lincoln and one of the most learned men of the Middle Ages… That he opposed… abuses of the papal administration is certain, but a study of his letters and writings… destroy the myth that he disputed the plena potestas of the popes.”

If a pope could be disobeyed by “one of the most learned men of the Middle Ages” for the lost of souls due to benefices then there is no doubt that the Francis/Parolin betrayal of the Chinese Church to the totalitarian Communist regime which will result in the loss souls must be disobeyed.

Moreover, the Arian heretics were saying the same thing about Doctor of the Church St. Athanasius when he as some historians say was excommunicated by the pope of the time. That he was in schism.

The saint was resisting the Arian heretic bishops even apparently outside the valid pope’s approval.

Cardinal John Henry Newman showed that a bishop can resist popes and other bishops.

Newman said Athanasius ordained priests against the authority of the Arian heretical bishops who were validly appointed bishops under the pope of the time.

In fact, scholar Joseph Bingham on page 98 in “The Antiquities of the Christian Church” said:

“Athanasius… made no scruples to ordain… [Bishop] Euesebius of Samosata… ordained bishops also in Syria and Cilicia.” 

Newman in his “The Development of Christian Doctrine” denied that Bishop Athanasius’s “interference” in the dioceses of the heretical Arian bishops was schism:

Also, serious scholars are claiming Francis is a material heretic. The 19 Scholar’s Open Letter say that Francis is a material heretic which also brings into play the Doctors of the Church St. Robert Bellarmine and Francis de Sales option on explicit heretical popes:

Finally, the theologian Dr. Kwasniewski stated “eminent canonists and theologians could maintain that a pope deserves to be resisted if he is guilty of injuring either tradition or the Christian people who rely on it”:

Cardinal Juan de Torquemada (1388–1468) states that if a pope fails to observe “the universal rite of ecclesiastical worship” and “divides himself with pertinacity from the observance of the universal church,”  he is “able to fall into schism” and is neither to be obeyed nor “put up with” (non est sustinendus).[14] The well-known commentator on St. Thomas, Cardinal Cajetan (1469–1534), counsels: “You must resist, to his face, a pope who is openly tearing the Church apart—for example, by refusing to confer ecclesiastical benefices except for money, or in exchange for services… A case of simony, even committed by a pope, must be denounced.”[15] Cajetan is talking about simony, the buying or selling of ecclesiastical offices, which was obviously a massive problem in centuries past; but it is far from being the worst sin or the greatest problem. Objectively speaking, the imposition of harmful discipline such as the promulgation of a valid but inadequate and inauthentic liturgy, or an assault on the integrity of doctrine, is certainly worse than simony. Francisco Suárez (1548–1617) declares: “If the Pope lays down an order contrary to right customs, one does not have to obey him; if he tries to do something manifestly opposed to justice and to the common good, it would be licit to resist him; if he attacks by force, he could be repelled by force, with the moderation characteristic of a good defense.”[16] Suárez moreover claims that the pope could be schismatic “if he wanted to overturn all the ecclesiastical ceremonies resting on apostolic tradition.”[17] (Note he says “resting on,” apostolica traditione firmatas: he’s talking about the whole structure that has been raised upon apostolic origins. That would mean something like the 1570 Missale Romanum.) The Dominican Sylvester Prierias (1456–1523), a leading figure in the initial response to Martin Luther, explains that if the pope is destroying the Church by evil actions,

he would certainly sin; he should neither be permitted to act in such fashion, nor should he be obeyed in what was evil; but he should be resisted with a courteous reprehension.… He does not have the power to destroy; therefore, if there is evidence that he is doing it, it is licit to resist him. The result of all this is that if the Pope destroys the Church by his orders and acts, he can be resisted and the execution of his mandate prevented. The right of open resistance to prelates’ abuse of authority stems also from natural law.[18]

Francisco de Vitoria (1483–1546) likewise says: “If the Pope by his orders and his acts destroys the Church, one can resist him and impede the execution of his commands.” St. Robert Bellarmine (1542–1621) concurs:As it is lawful to resist the pope, if he assaulted a man’s person, so it is lawful to resist him, if he assaulted souls, or troubled the state, and much more if he strove to destroy the Church. It is lawful, I say, to resist him, by not doing what he commands, and hindering the execution of his will; still, it is not lawful to judge or punish or even depose him, because he is nothing other than a superior.[19][…]To see that the position I am defending here is not extravagant, we should consider a famous proponent of it in recent times: none other than Joseph Ratzinger. In The Spirit of the Liturgy (2000), Ratzinger writes:After the Second Vatican Council, the impression arose that the pope really could do anything in liturgical matters, especially if he were acting on the mandate of an ecumenical council. Eventually, the idea of the givenness of the liturgy, the fact thatone cannot do with it what one will, faded from the public consciousness of the West. In fact, the First Vatican Council had in no way defined the pope as an absolute monarch. On the contrary, it presented him as the guarantor of obedience to the revealed Word. The pope’s authority is bound to the Tradition of faith, and that also applies to the liturgy. It is not “manufactured” by the authorities. Even the pope can only be a humble servant of its lawful development and abiding integrity and identity…. The authority of the pope is not unlimited; it is at the service of Sacred Tradition.
Benedict XVI takes up the same theme in 2005, in his first papal homily at St. John Lateran:The power that Christ conferred upon Peter and his Successors is, in an absolute sense, a mandate to serve. The power of teaching in the Church involves a commitment to the service of obedience to the Faith. The pope is not an absolute monarch whose thoughts and desires are law. On the contrary: the pope’s ministry is a guarantee of obedience to Christ and to his Word. He must not proclaim his own ideas, but rather constantly bind himself and the Church to obedience to God’s Word, in the face of every attempt to adapt it or water it down, and every form of opportunism. … The pope knows that in his important decisions, he is bound to the great community of faith of all times, to the binding interpretations that have developed throughout the Church’s pilgrimage. Thus, his power is not being above the Word of God, but at the service of it. Stop for a moment of silence, ask Jesus Christ what He wants you to do now and next. In this silence remember God, Father, Son and Holy Ghost – Three Divine Persons yet One God, has an ordered universe where you can know truth and falsehood as well as never forget that He wants you to have eternal happiness with Him as his son or daughter by grace. It is not sourced in the Sacred Magisterium and is explicitly contrary to governing Canon Law.It is lawless.It is unprecedented.It is revolutionary.Therefor it is invalid. Let all priests who adhere to Tradition join them (the humility required to join them, most especially for the FSSP, would be a good thing).
