Subject: OT: Oppose SB 303 – Time is of the Essence
Dear All,
 
I write to ask you to please immediately call House Public Health Chairwoman Rep. Lois Kolkhorst (R-Brenham) at 512-463-0600. Ask her to OPPOSE SB 303 which sits in her House committee. Every call counts!  Time is running short.  A call today would be most impactful.  End-of-life is part of the pro-life movement.  We must respect all life from conception until natural death.  Please help out!  It takes less than a minute and so few call that every call is all the more significant.
SB 303, under the guise of fixing existing law, really further takes away patient rights and allows doctors and hospital ethics committees to decide to withdraw life-sustaining treatment (which is defined to include artificially administered food and hydration) even over the patient or family’s objections. There is no recourse for the patient/family beyond the hospital ethics committee; no final recourse to court. It still allows for secret Do Not Resuscitate orders. Doctors have total immunity! They can never be questioned in a court of law for their decisions here as long as they follow the process that ends w/ the hospital ethics board (no conflict of interest there, is there)?
 
Please note – the Texas Advanced Directive Act that SB 303 would amend is very bad law.  However, this bill is not even an incremental improvement; does not address existing problems; and creates many new ones.  TADA needs amendment, but true amendment that would preserve and protect life.  This bill simply does not do that.  If this bill passes, there will be no momentum to fix the problems created here next session (which will be in 2015).  TADA has been on the books since 1999 and has been very difficult to amend so it is important to do it right or not at all.
And, Bobby Schindler’s opposition here – opposition, that is, directly against SB 303 itself.  Terri Schiavo’s name was used to promote this legislation and Bobby was very angry about that as you can see in this letter of his.  He’s read the bill and concludes, as many others do, that it would still allow the same thing that happened to his sister to happen here in Texas.
 
 
Ethicists do not all support this bill (although you’ll hear much about Fr. Tad supporting it and that is unfortunate):

So, the one Bishop we can say for certain that has read this bill is against it.  I realize that there are pro-life groups supporting it, including the Texas Catholic Conference, Catholic Pro-Life Committee, and Texas Alliance for Life.  That is causing great confusion and is unfortunate for oh so many reasons.  I cannot answer why they support this.  I’m asking you to look into this yourselves, draw your own conclusions by looking into the language of the law itself, and to look beyond the talking points and cute memes on Facebook.  I have asked pointed questions of the supporters and they do not answer w/ bill language, if they answer at all.  Most of the time they ignore questions.  That should tell you a lot there.
