The Biden Administration feels that it must now use federal resources to attack “disinformation.” So the Department of Homeland Security recently announced the creation of a “disinformation governance board.”

The board’s executive director, Nina Jankowicz, at least has clear qualifications for the post. She previously had spread false rumors on social media that Donald Trump voters would show up at the polls in 2020 armed, and joined the mob’s chorus that Hunter Biden’s laptop was “Russian disinformation.” Perhaps the idea behind her hiring was “it takes one to know one.”

Although the new board’s mandate is unclear, the idea seems to be that Jankowicz and her colleagues will use the federal government’s powers to adjudicate what Americans say as either true or false—and to suppress as “disinformation” anything it doesn’t find useful.

The new war against “disinformation” follows the narratives of the “insurrection” on January 6, the “democracy dies in darkness” return of Donald Trump, and Vladimir Putin as a mastermind gasoline price-spiker. Such narratives are intended to distract us from the Biden disaster and the ongoing assault against constitutional freedom. 

When things turn south for the administration, Barack Obama—a sagging Netflix’s $50-million “idea man”—usually emerges from one of his three mansions in Hawaii, Martha’s Vineyard, or Kalorama to lecture clingers and deplorables on various threats they pose to the anointed. 

His sermons usually project his own transgressions. Recently, Obama went to Stanford University, in the heart of Silicon Valley, to admonish us that new free speech platforms might tolerate incorrect expressions that he and the Left smear as “hate speech.”

But is not Barack Obama ill-suited to lecture anyone on disinformation? Do we remember his Obamacare version of disinformation: “You can keep your doctor; you can keep your plan”? Do we recall “shovel-ready jobs”?

Obama was caught secretly promising Russian leader Dmitry Medvedev that the United States would deal away missile defense in Eastern Europe for Vladimir Putin’s good behavior (“but it’s important for him to give me space”) during his 2012 reelection bid. Was this transparency or another example of how, but for a hot mic, “democracy dies in darkness”? Could Eastern Europeans have used such a discarded anti-missile system today?

Who employed the misinformationist Christopher Steele to slander presidential candidate Donald Trump? Was it James Comey’s FBI? Or Hillary Clinton’s campaign? Or the Democratic National Committee? Or the Perkins Coie legal firm? Or Fusion GPS? Or all combined? And which president was briefed regularly on his administration’s disinformation war against Trump?

For that matter, which media company banned any coverage of the Hunter Biden laptop story? Jeff Bezos’ Washington Post? Mark Zuckerberg’s Facebook? Jack Dorsey’s Twitter?  Or all of them?

Projection is a left-wing trademark. What it accuses in others reveals what it seeks to hide within itself. So when we hear Homeland Security Secretary Alejandro Mayorkas announcing this war on disinformation, we suspect he is our master disinformationist. Is it not his agency that is airlifting illegal aliens in the dead of night to regional airports rather than transparently, in the light of day? Is that “disinformation dies in darkness”?

What happened to the Biden Administration’s furious charges that the mounted border patrol was “whipping”innocent illegal aliens? When a federal investigation cleared the accused, did Mayorkas correct his own administration’s disinformation and apologize?

Who should we expect next to lecture the nation on the dangers of “disinformation”? A paroled and once-leftist heartthrob Michael Avanetti? Joe Biden himself on his own supposed ignorance of Hunter’s cronies? CNN and MSNBC on Hunter Biden’s “Russian disinformation” laptop? 

Will Anthony Fauci weigh in on the nonexistence of federal funding for gain-of-function research at Wuhan? Will Robert Mueller reemerge to restate yet again that he never knew anything of the Steele dossier? Will James Comey go back under oath to claim another 245 times he cannot remember? Will John Brennan lie a third time under oath before Congress, James Clapper a second time, or Andrew McCabe mislead a fourth federal investigator? 

What about those 51 former intelligence officials who convinced voters before the election that Hunter’s laptop was “Russian disinformation?”  Would Nina Jankowicz rule their letter of expertise “information,” “misinformation,” or “disinformation?”

Or perhaps we could hear warnings of organized misinformation from those blue-chip “17 Nobel Prize-winning economists” who vouched in a letter that Biden’s massive “Build Back Better” plan would not contribute to inflation that was indeed already ignited and beginning to blow up the economy?

Perhaps ex-felon and FBI lawyer Kevin Clinesmith could serve on the disinformation board, considering his keen eye for altered federal documents that advance false narratives. Hillary Clinton would also be a good candidate given her expertise in hiring sleuths like Michael Sussman to conjure phony Alfa-Bank stories?

So what are the catalysts for this sudden assault on free speech? Why is the Left now so worried after holding all the reins of power for 15 months? Why their embarrassing new Nineteen Eighty-Four-like Ministry of Information and Truth? And again, why now?

First, the looming midterms well may see the greatest repudiation of leftwing politics in the last 100 years. Rarely do hardcore leftists gain the reins of the Senate, House, and presidency. And more rarely are the Democrats foolish enough to go full socialist and emulate failed statist regimes abroad. And yet they have now done both—and have managed to alienate much of the country. 

Rarest of all is to have both a president and vice president who are force multipliers of the disasters that ensue from their policies. Joe Biden and Kamala Harris are no JFK, Bill Clinton, or Barack Obama. Instead, they make Jimmy Carter seem Ciceronian in comparison. 

The one cognitively diminished, the other blindly confident in her puerile ignorance, only add to the public anger over their disastrous 15 months. Surging crime, a nonexistent border, historic inflation, sky-high energy prices, record deficits and debt, racial polarization and appeasement, war, and humiliation abroad were all self-inflicted catastrophes, the logical bitter fruit of a diseased socialist tree. So fear of not just losing in November but also losing in humiliating fashion has made the Left more desperate than usual.

Second, leftwing politics are the operational face of a much larger social and cultural revolution that has also sickened the public and alienated the majority of voters—and also is about to “circle back” on its creators.

The media, Silicon Valley, CEOs, deep state, Wall Street, academia, Hollywood, and professional sports represent a vision of the future of America that most voters do not want. The scolding faces of the rich and pampered political, corporate deep state, and celebrity progressive crowd—Bill Gates, Mark Zuckerberg, John Kerry, the Disney crowd, George Soros, Anthony Fauci or James Comey, Black Lives Matter, Antifa, LeBron James, and Colin Kaepernick—grow wearisome and bore the public. 

This erosion of our culture reflects the growing political discontent in insidious ways: the fall-off of Netflix subscribers, the utter corruption of Black Lives Matter, the humiliation of Disney, the rapid collapse of CNN+, the grassroots revolt against critical race theory and transgender tyranny. 

Third, the Democratic Party no longer exists. It is now hard-left, as sanctimonious as it is shrill. Such zealots will not discard their ideology. Rather they would prefer to embrace dogma and stay unpopular than adopt and gain public approval. 

Do not expect a suddenly closed border, an abrupt resumption of the Keystone XL Pipeline, or a tough new federal crime bill. Do anticipate more wild conspiracy theories, more Russian disinformation, and more Pravda-like ministries.

In this context, the emergence of Elon Musk as the Silicon Valley dragon slayer is emblematic of the ongoing left-wing nightmare. 

As Musk pulls up the shades at Twitter, what are leftists to say: that billionaires should not become media barons, heretofore the pillars of the progressive movement? That suppressing free speech is more popular with the public than liberating expression? That some censorship is better than others?

We have seven more months before the midterms. As the disinformationists see no way out of their self-created Armageddon, expect more disinformation ministries, censorious czars, and hack grandees to emerge from the shadows.

As good Orwellians, they will try to convince us that high gas prices are welcome; negative growth is good; borders are ossified ideas; unaffordable housing aids the economy; inflation can prove useful; a declining stock market is encouraging; crime is a mere construct in the eye of the beholder. 

Anyone who doubts all that will have a rendezvous with Nina Jankowicz.

Court-packing — the attempt to enlarge the size of the Supreme Court for short-term political purposes — used to be a dirty word in the history of American jurisprudence.

The tradition of a nine-person Supreme Court is now 153 years old. The last attempt to expand it for political gain was President Franklin Roosevelt’s failed effort in 1937. FDR’s gambit was so blatantly political that even his overwhelming Democratic majority in Congress rebuffed him.

Yet now “court-packing” is a law school cause celebre. It is hailed as a supposedly quick fix to reverse the current 5-4 conservative majority.

Recently, a rough draft of an opinion purportedly overturning the Roe v. Wade decision that had legalized abortion in all 50 states was leaked to the media by someone inside the court.

That insider leak of a draft opinion was a first in the modern history of the Supreme Court. It violated all court protocols. Yet it was met with stunning approval from the American Left.

The leaker either intended to create a preemptive public backlash against the purported court majority in the hope that one or two justices might cave and switch under pressure — or to gin up the progressive base to fend off a likely disaster in the November midterm elections.

The recent leak, however, is consistent with a left-wing assault on the Court that has intensified over the last five years. Democrats have gone ballistic ever since former presidents George W. Bush and especially Donald Trump’s appointees solidified a conservative majority.

During Brett Kavanaugh’s confirmation hearings in 2018, protestors stormed the Senate chambers in protest. The Left rallied behind the now-convicted felon Michael Avenatti, who publicized crazy, wildly untrue charges about a teenaged Kavanagh.

Later in spring 2020, Senator Chuck Schumer, D-N.Y., whipped up a protest crowd right in front of the Supreme Court. He directly threatened justices Neil Gorsuch and Kavanaugh. “I want to tell you, Gorsuch, I want to tell you, Kavanaugh, you have released the whirlwind and you will pay the price. You won’t know what hit you if you go forward with these awful decisions.”

What exactly did Schumer mean by “you will pay the price” or “you won’t know what hit you”?

Who or what would hit the two justices — and how exactly?

But it is not just the court the Left is targeting. Long-standing institutions and even constitutional directives are now fair game.

At the 2020 funeral of Representative John Lewis, D-Ga., former President Barack Obama crudely proposed bringing in Puerto Rico and Washington, D.C. as states — and with them likely four left-wing senators.

Obama’s “eulogy” also damned the 180-year-old Senate filibuster. Yet as a senator, Obama himself resorted to the filibuster to block the nomination of Supreme Court Justice Samuel Alito.

The Electoral College is under continued assault, especially since George W. Bush in 2000 and Trump in 2016 were elected without winning the popular vote.

The founders’ arguments for the Electoral College are never mentioned. But the drafters of the Constitution felt it forced candidates to visit rural areas. They believed it would discourage European-style multiple splinter parties. It made voter fraud more difficult on a national scale. And it emphasized the United States of America. That is, America today is 50 unique states that are represented as such in presidential elections.

The Biden Administration also narrowly failed to push through a national voting law. Such legislation would have superseded the states’ constitutional rights to set most of their balloting protocols in national elections.

So what is behind:

·       leaking Supreme Court drafts of impending opinions, 

·       seeking to pack the Supreme Court with 15 justices, 

·       ending the Senate filibuster, 

·       adding two more states to the 60-year-old, 50-state union, curtailing states’ rights to set their balloting procedures, 

·       trashing the Constitution’s Electoral College?

The answer to those questions also applies to President Joe Biden’s promise to cancel millions of contracted federally guaranteed student loans simply by a pre-midterm election executive fiat.

And how can Homeland Security Secretary Alejandro Mayorkas openly negate federal immigration law? How can he welcome millions to cross illegally the southern border?

The answers are obvious.

The hard Left has detoured from the mainstream of American voters onto a radical trajectory. It will never find 51% public approval for any of its current extremist and crackpot initiatives.

Instead, it sees success only through altering the rules of governance or changing the demography of the electorate — or both.

Still, leftists should be careful about what they wish for.

Latinos are historically transforming en masse into conservative voters.

Leftists are also greenlighting powerful precedents for the next Republican president. He may follow their lead by simply changing any rules, laws, customs, and traditions anytime he deems them inconvenient.

Catholic League president Bill Donohue comments on pledges to attack Catholic churches:
The cops will hopefully be out in force this Sunday to monitor planned attacks inside Catholic churches. A left-wing fascist group, Ruth Sent Us, is asking its followers to crash Catholic churches on Mother’s Day.
Vandals have already struck in Boulder, Colorado, desecrating a church, and pro-abortion lunatics have rioted in Los Angeles.
Ruth Sent Us is named after Supreme Court Justice Ruth Bader Ginsburg. While she was an abortion-rights advocate, she also made it clear that the decision to legalize abortion should not have been made by the Supreme Court—it was up to lawmakers to render such a ruling. Moreover, she was never one to promote violence, never mind counsel a Nazi-like attack disrupting Mass.
Thus, Ruth Sent Us is wildly out of step with the thinking of the person they claim to be honoring. In fact, they are dishonoring her legacy.
We will press the authorities to prosecute any attack on a Catholic Church as a hate crime. These thugs need to be stopped in their tracks.
If President Biden does not address this issue, he is aiding and abetting anti-Catholicism.

Convincing the Apathetic Middle the Truth About Abortion

Barring some sort of cataclysmic disaster, and assuming the confirmed leak from SCOTUS indicating an impending reversal of Roe v. Wade isn’t an elaborate hoax, it seems that legalized abortion will be taking a mortal blow very soon. Praise God. This is an unbelievable thing, and it still has me in shock.

Although I sit on the other side of the Covid Curtain, and my Soy Minister in Chief has yet again shown he is a lapsed Catholic apostate by trumpeting the “right to abortion,” I am overjoyed at the thought of the international precedent this will set. America, the most powerful nation on earth, will very soon stare down the slaughter of innocents and tell Moloch to take a time out. That demon has had his hour, but God will have His day.

Of course, this does not mean that abortion will go away in toto, as it will be kicked to the states, some of which will doubtless set up their own temples to Baal as they plunge infants into the trash can in order to appease the demon-gods of prosperity. The federal framework of abortion being struck down does not mean that abortion goes away, but it will be reduced dramatically; and this must be celebrated and shouted from the rooftops.

Throughout the coming months and years, there will commence a battle of existential proportion for the soul of a nation, the world that watches in disbelief, and, most importantly, the souls of the infants and adults involved in the destruction of innocent human life. 

At 34 years old, I do not know what it is like to live in a world where aborting one’s child is not a normative activity for a secular person. Abortion has been normalized for my generation to such an extent that what has followed is not so much an intrinsic “for or against” the procedure, but instead, a general apathy.

Many in my millennial cohort have never even considered the question of when life begins. The lie that a child in the womb is just a “clump of cells” or “not fully human” is as mundane a truth for the masses as saying something like “too much sugar is bad for your teeth.” There are minorities of strongly pro-life people and strongly pro-death people on the relative fringes of the population, but there exists a large, squishy middle that has no real opinion on the subject.

No doubt emotions and hopes are high in this pro-life moment in a way that they never have been. Finally, it seems, the good guys will have a massive victory and the Gates of Hell will surely not prevail. However, in this fight against Satan and his anti-sacrament of Child Sacrifice, we must venture forward with the apathetic majority in mind, as they are the ones who can still be converted to sanity—unlike the unhinged leftist crowd who will require either a miracle from Heaven or a lobotomy to drop their tired and lifeless reasoning. 

For the apathetic middle group, phrases like “abortion is murder” are an almost guaranteed turnoff and are found repulsive. Please, do not confuse my meaning or intention and think that I am trying to pretend that abortion is not, in fact, a homicidal crime—it is. However, when the average person thinks of “murder” they have in their mind a more technical and legal idea that corresponds to the historic definition of willful homicide.

In the law, we speak of mens rea and actus reus, which is to say the guilty mind and the guilty act. For someone to be fully culpable for a grave crime, they must willingly commit a grave act with sufficient reflection and clarity of mind. We understand this easily as Catholics, as it is the theology behind mortal sin—something that has to be done freely and with knowledge and intention.

Regarding the crime of abortion, it has historically been dealt with under the tradition of Common Law, with varying degrees of punishment. It has been called feticide, or child destruction, and in cases where a person intentionally murders the unborn child of a pregnant woman who has not chosen abortion, many places rightly call this a form of murder.

However, in a world where generations have been raised to not see abortion as murder, or to not see the fetus as a person with rights, it is a hard sell to argue to the apathetic majority that abortion is murder. Again, this is not to take away from the crime; it is just an observation.

When we say something is murder, then it is assumed that those involved are murderers. Personally, I believe that the abortionist is a murderer, as he should know better. However, it would be a stretch to say that many of the confused women who seek out the procedure are acting as murderers. As someone who grew up in a fully secular environment, I can tell you that there was never any talk in any of the relevant institutions that form children that would teach a young person the truth about life in the womb.

In addition, many women are regrettably pressured into the activity by a variety of stressors. None of this is to say that there should be no retribution or culpability. It is only to say that from a legal perspective, and a philosophical perspective, the mens reaand the actus reus are simply not there in most cases.

Ultimately, I make these points to suggest that we must proceed with realism in the pro-life moment. It will arguably be legally futile to march forward with a clarion call to have all those involved with abortion treated as “murderers” because many of them simply aren’t. It is a delicate moment we find ourselves in, and the good guys are finally going to have the upper hand. We have a great responsibility on our shoulders, as we possess the truth. Thus, finding a way to transmit this to our neighbors will be paramount in bringing forth a change in the hearts of people and not just in the codes of law.

If we want to ensure lasting pro-life legislation to the best of our abilities, then keeping in mind the nuances of the legal realities surrounding abortion will only help our cause and ensure that Roe v. Wade is buried in the pits of Hell for good.

Celebrating Mother’s Day In Abnormal Times

In normal times, Mother’s Day was a time to honor mothers. But these are not normal times. In elite quarters today, there are those who want to eradicate this special day as we know it. Yes, even Mother’s Day has become politicized. It’s time for a tutorial on this subject.
Two men cannot have babies. Two women cannot have babies. Only men and women can have babies. This explains why, throughout all of history—up until about a week from yesterday—no one thought this to be controversial. Today it is.
Many men who claim to be married to their boyfriend, and who claim to be parents, are in a quandary over Mother’s Day. The children they have adopted are denied the right to be with their mother, so what do these two “fathers” want to do about Mother’s Day? They want to cancel it. 
In the name of being inclusive—they worship inclusivity—they want us to celebrate “Surrogate and Egg Donor Day.” But that is not being inclusive: It excludes sperm donors. Others suggest “Parent’s Day.” But that doesn’t resolve what to do next month when we have Father’s Day.
In keeping with the virtue of inclusivity, the ruling class has declared motherhood to be inclusive of men.
Apple recently released a “pregnant man” emoji. Last year, Rep. Cori Bush celebrated Mother’s Day by talking about “birthing people,” a term coined to be inclusive of men who claim to be pregnant. Similarly, in 2020 Harvard Medical School referred to mothers and women as “birthing people,” a clear demonstration of its commitment to inclusivity. Three years ago, the ACLU declared that “Men who get pregnant and give birth are men.” Question: Can these men also have a miscarriage?
In normal times, a company like Apple would be laughed out of town, Cori Bush would be sent to the nearest psychiatric ward, Harvard Medical School would be stripped of its accreditation, and the ACLU’s top brass would be quarantined. But these are not normal times.
This madness has become so mainstream that men who claim to be mothers are trying to breastfeed their babies. I’m not making this up.
Last year a man who claimed to be the mother of an adopted baby—his boyfriend claimed to be the father—expressed chagrin at being unable to milk the baby. “The baby has been able to latch, but I’ve not been able to produce any milk.” Nonetheless, he found success in failure. “Being able to even be a part of a process where I’m trying to create milk, it makes me feel very excited.” He’s giving new meaning to the term “milkman.”
Nature, however, is stubborn. Consider how various internet sites dedicated to motherhood handle the question of whether women who are pregnant for the first time are entitled to celebrate motherhood. They are actually sane.
Habitatformom says, “Yes, you can celebrate Mother’s Day during your pregnancy. Being pregnant means that you are already a mother anyway. You don’t need to physically hold the baby in your arms to be considered a mom.” Similarly, Jacqueline Whitmore, an etiquette expert, commented at Romper that “She’s still a mother, even if she’s not physically holding the baby in her arms.”
Babyprepping says, “Of course [you can celebrate Mother’s Day]. You count 100%. That baby inside of you, growing strong and beautiful, has a heartbeat and is your baby.” Pricklymom opines, “No one can deny the fact that you are already a mother. You’ve spent weeks or months worrying about every little movement of your baby.”
These comments from normal people will not sit well with those who think men can get pregnant, never mind pro-abortion activists.The world has always had its share of wannabes. In normal times that meant men and women who pined to be someone they would like to be. Today it means men and women who want to be someone they can never be. Denied by nature, and nature’s God, they have embarked on a quest they can never win. So sad.

The extraordinary overruling of Roe v. Wade

In an unprecedented leak of an opinion of the United States Supreme Court, it appears that the Court has voted to vacate the landmark and notorious 1973 case Roe v. Wade, which invalidated States’ laws protecting the life of unborn children. On May 2, the online magazine Politico posted what purports to be a draft opinion by Associate Justice Samuel Alito, writing for a majority of the Court in the case of Dobbs v. Jackson Women’s Health, which asked whether the State of Mississippi violated the United States Constitution in passing a law prohibiting abortion after 15 weeks of gestation.

The draft expressly overrules Roe v. Wade: “We hold that Roe . . . must be overruled. The Constitution makes no reference to abortion, and no such right is implicitly protected by any constitutional provision”. It is difficult to say which is the bigger news story: the leaked draft opinion, or the content of the opinion itself. And it is important to consider the implications of the decision, assuming it is genuine, for the future of abortion law in the United States.

Historically, the Supreme Court is one of the most impenetrable institutions in any branch of the government of the United States. Year after year, opinions with enormous public import, are closely guarded by the Court until the day that it makes an official announcement of its decision and releases its opinions. Indeed, the most contentious cases seem to be the most closely guarded, not being released until the last week of the Court’s sessions each June or July. Thus, this leaked opinion is among the most extraordinary news events in the history of the Court.

As of this writing, it is mere speculation as to who might have caused the leak. Each Justice of the Court employs four clerks. These are typically young attorneys, only recently graduated from their law schools. Needless to say, it is the most prestigious clerkship in the federal court system, and it goes only to the very best students from the most elite law schools. Each of the 36 clerks this term would have access to the decision, because it is circulated among the associate justices for comment and criticism before it is finalized. In fact, the leaked draft has a routing note, indicating whether or not each justice has read the opinion. If a clerk leaked the draft, it is almost certainly the end of that clerk’s legal career. This is a breach of an attorney’s most important professional responsibility, absolute secrecy where secrecy is required.

Of course, the motivation of a clerk (or justice) to leak the opinion is also speculation. Why would someone destroy his or her legal career by this shocking breach of the Court’s ethics and protocol? It is far more likely that it would be leaked from one of the justices who voted in the minority, probably to foment anger and activism by pro-abortion proponents, senators, and members of Congress. Indeed, almost immediately, Vermont Senator, Bernie Sanders, called upon the Senate to pass federal legislation prohibiting States from passing laws that would protect unborn children. And other pro-abortion politicians have made similar comments.

As to the substance of the draft Dobbs opinion, it is also extraordinary. “Roe was egregiously wrong from the start”, writes Justice Alito. “Its reasoning was exceptionally weak, and the decision has had damaging consequences”. He continues to explain that “Roe’s constitutional analysis was far outside the bounds of any reasonable interpretation of the various constitutional provisions to which it vaguely pointed”. As such, Alito concludes, “It is time to heed the Constitution and return the issue of abortion to the people’s elected representatives. . . . That is what the Constitution and the rule of law demand”.

This is a reminder that in many of the 50 States, abortion on demand will remain the law. Many states have “trigger laws”, which will go into effect when Roe is overturned, and essentially allow for the same radical abortion regime as Roe did. But other States, such as Mississippi, Ohio, Texas, and others, have legislation prepared that will severely regulate abortion, if not make it altogether illegal in almost every situation. And, of course, there is a continuum of legislation among other States, regulating access to abortion, but not making it illegal in all cases.

Thus, the abortion wars in the United States are not over by the vacating of Roe v. Wade. The battle lines are merely redrawn from Washington, D.C., to the legislative assemblies of the various states. And the activists on both sides are highly motivated by this leaked draft, ready to go to the barricades on every front. But Dobbs is a godsend, in that it at least allows the people to decide this important decision, taking it away from the nine Justices who had no business making the decision in the first place.

LESS ISN’T MORE — Political power is a tiger’s tail. Once you grab it, you’d better figure out a way to hold it without getting dragged down. Democrats’ less-than-firm grip is on full display after the publication of the Supreme Court’s draft majority opinion that would overturn Roe v. Wade.On its face, the draft opinion’s disclosure by POLITICO would seem to give Democrats a clear opportunity to galvanize their voters — women voters in particular, who broke overwhelmingly for them in 2020 — after half a year of arcane and unproductive procedural drama.The document, written by conservative Justice Samuel Alito, crystallizes the stakes of the midterms: Republicans are nearly unanimously opposed to abortion and are poised to follow up on any toppling of Roewith further restrictions on access.But it has not galvanized a majority of the Senate. Democrats are calling up a bill next week that would establish a federal right to receive an abortion, and for medical workers to provide abortions, along with broader abortion-access provisions. It’s all but guaranteed to result in a tally similar to February’s vote on the matter: 46-48.Every Republican, including pro-abortion-rights Sens. Susan Collins of Maine and Lisa Murkowski of Alaska, voted no then. So did Sen. Joe Manchin (D-W.Va.).There is a path to getting Collins, Murkowski, and possibly even Manchin on board for a narrower bill that would codify Roe and Casey into the law of the land in all 50 states. The two GOP women have their own bill that would establish abortion rights on the federal level. It’s far more narrowly tailored, with carve outs for objections from medical workers based on religion or conscience. It’s also more focused on abortions in early pregnancy. Democratic leaders have no plans to call it up.Not because they’re convinced it’s a bad idea, necessarily — Senate Majority Whip Dick Durbin (D-Ill.)told our Marianne LeVine this weekthat, given Collins and Murkowski’s votes for recently confirmed future Justice Ketanji Brown Jackson, he wanted to see “if there’s any common ground” on their bill.Sen. Mazie Hirono (D-Hawaii) gave the clearest explanation of the political logic behind giving Collins and Murkowski the stiff-arm: Neither bill is going to pass, so why not vote for the one that Democrats think is better?Hirono told Marianne that she saw no fundamental difference between a bipartisan group of as many as 52 senators uniting to codify Roe and a Democrats-only vote that will likely top out at 46 senators. Neither one can get past a filibuster.“The way I’m seeing it,” Hirono said, “if it’s bipartisan and still won’t pass, it’s the same thing as us Democrats voting on a bill.”Except that Democrats have spent two years decrying minority rule in the Senate. Most of the Democratic Party is trying to chip away at the legislative filibuster that requires 60 votes to pass most bills. The failure of an abortion-rights bill that passed with 52 votes would seem to be be a stark illustration of how the Senate works now.In addition, Democrats have spent most of the current Congress fixated on doomed party-line pushes — from the defunct social spending bill known as “Build Back Better” to the voting reform plan thatran aground in the Senate in January. It might be a refreshing change of pace to top 50 Senate votes on something.And if progressives take issue with the narrower scope of Collins and Murkowski’s bill, well, the duo seem open to a discussion. Collins was pretty clear on her standards Thursday, saying that “I’m not trying to go beyond current law.”Some Democrats might argue that forcing every Republican to be on the anti-abortion side of a reenergized debate over Roe presents a sharper display of the contrast between the two parties, and what’s at stake in November. They have a valid point. Yet it’s not particularly clear that aligning with Collins and Murkowski — two centrists who voted to convict Donald Trump in his second impeachment trial — would step on that message in any meaningful way.Democrats appear locked in to displaying one more fruitless exertion of their power, just as they did in January on voting rights and in the fall when the House passed a $1.7 trillion bill that imploded in the Senate.Their majorities might end this fall with a Collins-and-Murkowski-backed infrastructure bill as the crowning achievement of this Congress.
