The 17+ Women in El Salvador: A Case of Infanticide Impunity in the Name of Abortion Rights

FEBRUARY 9, 2020BY LIGIA DE JESUS CASTALDIAmerican pro-abortion supporters, Western embassies and international human-rights bodies have taken part in the war against El Salvador’s full ban on elective abortion by supporting a fraudulent campaign that promotes impunity for infanticide in that country.

Decriminalization of infanticide seems to be the next frontier in pro-abortion advocacy, both nationally and internationally. The Center for Reproductive Rights, a United States-based organization, and its main affiliate in El Salvador, the Agrupación Ciudadana por la Despenalización del Aborto Terapéutico, Ético y Eugenésico [Citizens’ Group for Decriminalization of Therapeutic, Ethical and Eugenic Abortion], have advocated the release of at least twenty-three women who were convicted of criminal homicide by a court of law in El Salvador after they killed their newborn children.

Decriminalization of infanticide seems to be the next frontier in pro-abortion advocacy, both nationally and internationally.

The group of female inmates is called “the 17+” (“las 17+”) in media campaigns, an emblematic number alluding to the organizations’ defense of more than seventeen women accused and convicted for infanticide. As of early 2020, litigation has resulted in the release of at least nine convicts either on parole or commutation (pardon or clemency granted by the country’s president), and the reversal of five convictions. This makes for a total of at least fourteen released inmates, all of whom had been serving prison sentences for criminal homicide of their own biological children shortly after birth. Potential grounds for defense such as insanity, diminished mental capacity, or extreme emotional disturbance were taken into account by Salvadoran courts. In almost every instance, courts gave perpetrators the minimum sentence established for criminal homicide.

The newborn children victimized in these crimes suffered unspeakable violence. Babies killed by the 17+ inmates were beaten, stabbed, strangled, and drowned in toilets and septic tanks. Their bodies were disposed of in a degrading and inhumane manner and found rotting among human waste, in plastic bags or cardboard boxes; some bodies were abandoned in fields and partially eaten away by wild animals. VIDA SV, a pro-life organization from El Salvador, has published trial court documents that contain more details about each case’s facts, photographic evidence, trial, conviction, and appeals in Salvadoran courts (discretion advised).

In the case of the 17+, pro-abortion advocacy for impunity for infanticide is not openly presented as such; it is styled as a fight for decriminalization of abortion in El Salvador and Latin America. The facts of each case, corroborated by scientific and documentary evidence as well as witnesses’ testimony, all of which are known to the Center for Reproductive Rights and its affiliate, have in every instance been deliberately distorted to conceal or minimize the death of a newborn child at the hands of his or her mother. The aggravated homicide of newborn infants have been mischaracterized as “abortion,” “miscarriage” or “obstetric emergency.”

Zeal for any cause, including the cause of abortion rights, does not give one a license to lie. Salvadoran criminal law does not penalize spontaneous abortion or involuntary miscarriage, that is, the involuntary death of an unborn child. Neither does it penalize obstetric emergencies. In fact, in 2007, El Salvador’s Supreme Court interpreted its Criminal Code as containing a “necessity” defense (estado de necesidad) for abortion where the mother’s life is endangered by carrying the pregnancy to term. El Salvador’s criminal statutes, like those of at least twenty-three other Latin American countries, do punish elective abortion. The law, however, does not seem to be enforced against women, since official reports indicate that no women are currently imprisoned for induced abortion in El Salvador, even in the rare event of a conviction. Pro-abortion organizations promoting “the 17+” and “Manuela” litigation are claiming infanticide convicts are women incarcerated for having abortions, miscarriages, or obstetric emergencies.

In an era of “fake news,” the campaign for the release of “the 17+” women convicted of infanticide is a perfect illustration of mass dissemination of false information. Public statements against El Salvador’s ban that demand freedom for the 17+ inmates were issued by United Nations human-rights bodies and Hollywood actresses, such as Alyssa Milano, Sarah Hyland, and Padma Lakshmi. European and Canadian ambassadors broke diplomatic rules by sponsoring pro-abortion advocacy events about the 17+ women, and some of them even made appearances at trial hearings. Similarly, in November 2019, U.S. Democratic congresswomen Stephanie Howse, Merika Coleman, Cindy Polo, Raquel Teran, and Nikema Williams traveled to El Salvador and photographed themselves with thirteen inmates, condemning El Salvador for their incarceration.

According to pro-abortion advocates involved in the campaign, female perpetrators of infanticide, not their children, are victims of human rights violations. The Inter-American Commission on Human Rights (IACHR), an agency that recently lost funds from the U.S. government for pressuring Latin American pro-life countries to decriminalize abortion, held public hearings and repeatedly urged El Salvador to review the convictions of the 17+ women imprisoned for criminal homicide of their own children, and to eventually release them. The IACHR also filed suit against El Salvador before the Inter-American Court of Human Rights for the conviction of one of the women, “Manuela” (a pseudonym), convicted in 2008. The IACHR asserted that Manuela’s allegedly wrongful conviction, like those of “the 17+”, was caused by El Salvador’s full ban on voluntary abortion. It remained silent about any violations of children’s rights.

The campaign against El Salvador goes beyond the infamous Virginia bill allowing the killing of abortion survivors (“post-natal abortion”), or the Dutch Groningen Protocol allowing the killing of severely disabled newborn children (neonatal euthanasia). Instead, it proposes the application of a “gender perspective” to criminal prosecution, according to which the perpetrator’s female gender would lower the criminal degree, reduce penalties, or eliminate the crime altogether for a crime against a very young child.

It is unclear whether the litigation will actually lead to decriminalization of abortion or impunity for infanticide in El Salvador, which, despite its poverty and multiple political problems, has had one of the strongest pro-life legal traditions in Latin America. The litigation, however, seems already to have desensitized public opinion somewhat to the killing of unborn and newly born children. Several government officials, including a supreme court judge, have actively supported the campaign and advocated tolerance of infanticide and decriminalization of abortion.

If anything, the macabre proposal to tolerate infanticide, in the name of abortion rights, has shown the world the infanticidal logic of abortion and a darker side of the international pro-abortion movement, which seems to be radicalizing to previously unimaginable lengths. The treatment of abortion and infanticide as equivalents, on the part of pro-abortion organizations involved in this litigation, is obviously meant to deceive the public; but it also seems to be based on equal disregard for the life of the unborn and the newly born child. The argument that gender alone justifies the deliberate killing of one’s own child in both situations is also very telling. It seems to confirm what pro-lifers have known all along, namely, that abortion and infanticide are not that different after all.

If there is to be a uniting of Catholics opposed to the Anti-Church it can only be of those who chose to be motivated and loyal to the divine faith, period. It has to arise from a spirit higher that political motivation and it has to be free from the errors of such political movements. It cannot include those who say being a faithful Catholic requires or allows you to be a socialist, a progressive, a facist, a marxist, etc.. DIVINE FAITH VS. SOCIAL ACCEPTABILITY

Beware: not all men have faith — says Saint Paul. This is a Scripture which in previous generations was not considered so significant, because all had faith and no one publicly contested it. If you did what everyone else was doing you would be deemed faithful. And no one noticed.

But in the Great Apostasy, this principle of going along with the herd, fails. Because the herd is no longer the sheep of the Lord and no longer in the sheepfold of the Lord.

Christ did not call us sheep for nothing. He knows we tend to follow the herd. This is even true in countries like the United States of America which has strong currents of individualism in its national culture and society.

I remember nearly 20 years ago, when I was invited to attend a Trad Inc. conference and afterwards I was invited to a reception. Out came the liquor and a lot of it. I drank water. Everyone seemed somewhat surprised and obsessed to as why I did this. I said I am a son of Saint Francis, and I have renounced the world. After about 30 minutes no one wanted to talk to me, and no one could talk to me. That was the last reception of Trad Inc. I went to. I set my sights on finding a monastery or hermitage in Europe after that, as I never liked herds, especially ones not headed in the direction of Christ Crucified.

With Bergoglio’s usurpation of the papacy, I see the same psychological behaviors which broke out in the USA when Obama first ran for the presidency. Being born of a Kenyan Citizen and a mother who was a minor at the time, he was born a native of the Crown Colony of Kenya. His grandmother said he was born in Kenya, which would mean that he was a natural born citizen of Kenya. For more than a decade, he and his wife claimed he was a Kenyan, born in Kenya, or implied the same during his visits there. All US records of persons returning from Kenya during the week of his birth at the port of Honolulu went missing after his election.

That controversy regarded the U.S. Constitution’s requirement that every U.S. President be born on U.S. soil of 2 parents who both were U.S. citizens at the time of the child’s birth. It is an objectively verifiable requirement. In the election of 2008 the entire political establishment in the United States of America ignored the requirement. Constitutionally, therefore, the entire presidency of Barrack Obama was a fiction. He was a usurper and none of the laws he passed had or have legal force. But the ruling class ignored it, because many of their children are not natural born citizens, as the Constitution requires, and but are rather of mixed citizenship and birth as globalism demands.

That Bergoglio should be thrust into power after an unexpected, apparent and strange abdication by Pope Benedict is not therefore surprising. It was an extension of the globalist agenda to put into power men who were not qualified for office and in a manner which was extralegal. The entire propaganda arm of the MSM worldwide supported both revolutions. Even to this day, the MSM never says anything bad about Obama, he is their messiah.

If I recall correctly, Trad Inc. ignored the questions about Obama just as they ignored the questions about Bergoglio, whether arising from the vote canvassing in the Conclave or the problems in the renunciation of Benedict. Their positions on both are consistent. They accept as true whatever narrative the Left puts out and they accept without question the legal arguments which the party of the anointed-of-the-Left put out.

I think they do this, because the Traditional Movement in the Catholic Church came into being with strong influences from international Conservatism, of the kind sponsored by the Masonic Lodge, which never really want to fight the left, only go leftwards at a slower pace. This is not the common definition you hear of Conservatism in the USA, because its too impolitic to speak of it. But if you read what Conservatives stood for 60, 40, and 20 years ago, and compare it to day, you will see what I mean.

The Divine and Catholic Faith, however, teaches us to hold fast to truths and teaching without any alteration over any length of time. This regards principles of law, principles of philosophy as well as the Deposit of the Faith and perennial Magisterium. This is why inside the Traditional Movement there are actually 2 camps which 2 different principles of inspiration, but only one is of God, and that one is clearly not in power.

This approach is not going to be accepted by those who want to attend the cocktail hours and hobnob with the influential and famous. It has to be composed of those who care not at all for social acceptability, and everything about being loyal to God the Father in the Catholic Religion.

ALINSKI’S RULES FOR RADICALS, USED AGAINST THE CHURCH

Saul Alinsky was a radical Marxist Jew from Chicago, USA, who before his death, compiled 13 demonic rules for how to overthrow social groups, based on his experience in organizing collective action against established political, social and religious structures. He published these in a book entitled, Rules for Radicals. — Here, the word, “radical” means a Marxist of the Gramescian kind who seeks to undermine a non-Marxist society from within so as to bring down the system, rather than organizing the proletariat for open armed revolution.

Alinsky’s 10 Rules for Radicals are a sort of luciferian way of practicing deceit in the most concealed and vicious manner. They are the classical reflection of an distorted passive aggressive psychopathy which recognized no objective moral norm to respect, uphold or promote the common good, and contrariwise inverts the approach the individual should have to that common good by advocating what is directly opposed to it. These rules are, thus, truly demonic:

  1. “Power is not only what you have but what the enemy thinks you have.”
  2. “Never go outside the expertise of your people.”
  3. “Whenever possible go outside the expertise of the enemy.”
  4. “Make the enemy live up to its own book of rules.”
  5. “Ridicule is man’s most potent weapon.”
  6. “A good tactic is one your people enjoy.”
  7. “A tactic that drags on too long becomes a drag.”
  8. “Keep the pressure on.”
  9. “The threat is usually more terrifying than the thing itself.”
  10. “The major premise for tactics is the development of operations that will maintain a constant pressure upon the opposition.”
  11. “If you push a negative hard and deep enough it will break through into its counterside.”
  12. “The price of a successful attack is a constructive alternative.”
  13. “Pick the target, freeze it, personalize it, and polarize it.”

Since the Bergoglian revolution is being run by Marxists — that is undeniable — it should not surprise us that those fellow Catholics who recognize Bergoglio as their leader should either openly advocate Marxism or use the tactics of Alinsky to counter Bergoglio’s enemies — the chief of which are those Catholics who recognize the teaching of the Church regarding when a Pope duly resigns and when he does not. Since Pope Benedict XVI never duly resigned, he is still the pope. And profession of that historical fact is the chief and most destructive assault against the Big Lie, used by the Bergoglian Church, to present itself as the Church of Jesus Christ and deceive the Elect.

Errors of the “Recognize and Resist” Movement

Catholics are increasingly aware that these tactics are being used now by Trad Inc. to sustain their ridiculous position of “recognize and resist” — This position holds that a Catholic is morally, doctrinally and canonically obliged to hold that Bergoglio is the Pope, but that he is also morally and doctrinally obliged to oppose his errors. — In practice, the “Recognize and Resist” Movement is one which denies that Bergoglio has ever uttered a formal heresy or that if he has he is never pertinacious in adhesion to it. Furthermore, they hold that canon 1364 can never apply to him, because he is the pope, even though Canon Law makes for no such provision or privilege. They deny the entire teaching of the Fathers and Doctors of the Church that formal, manifest pertinacity in heresy causes a man to lose all membership, office and dignity in the Church. And they especially deny that the words of Canon Law or of the Declaratio of Pope Benedict XVI have any precise meaning or use if it contradicts their position.

Thus the “Recognize and Resist” Movement is more about recognizing and very little about resisting. And thus its effect is totally about causing Catholics to submit to the Bergoglian Church and practice non-think about the abominations, heresies and scandals which are going on, not to mention, about the failed renunciation of Pope Benedict XVI. Indeed, the “Recognize and Resist” Movement seems to be a position slightly to the right of Opus Dei, which is all about Recognizing and nothing about Resisting in public — they in fact tell their members to shut up and stop thinking about the problems and stop being active on social media.

Therefore, it should not surprise anyone, that the “Recognize and Resist” Movement has begun to employ Alinsky’s Rules for Radicals, because in the defense of a lie there is no better tool that to employ the demonic.

Recent Attacks on Ann Barnhardt et alia

Ann Barnhardt is a pubic figure in the United States of America, who is famous for her commentary on current issues which cuts to the heart of the problem. Since the spring of 2016, she has rightly and sanely argued and demonstrated that the Renunciation of Pope Benedict did not separate him from the Papal Office and that the claims that he is no longer the Pope are the Big Lie of the present crisis of the Church. Countless Catholics today recognize Pope Benedict XVI because of the work of Barnhardt and those who came to know the truth of Church teaching and Canon Law about papal resignations through her. This is why the enemies of Pope Benedict seek to attack her more than anyone else. She blogs at Barnhardt.biz.

The recent attacks on Ann Barnhardt, chief of all, seem to be employing the Rules for Radicals. In Saul Alinsky’s Rules for Radicals, we have, for example, Rule 13, “Pick the target, freeze it, personalize it, and polarize it.”  This means, in regard to persons, to dissuade the public from consideration of the truths professed by an individual by attacking that individual on personal issues.

Then there is Rule 5, “Ridicule is man’s most potent weapon,” which has been honed into a fine art by Steve Skojec, editor and publisher of OnePeterFive.com — apparently a commercial site, because of its *.com, but in reality organized in US Law as a non-profit, where it appears from its tax filings 100% of funds raised, after expenses, go to Skojec or family members.*

Then there is Alinsky’s Rule 6, “A good tactic is one that your people enjoy,” which seems to be the case with Skojec, because he would not revel so much in insulting others, if he did not enjoy it. It also seems to be enjoyable to the rest of Trad Inc. because NONE of them — to my knowledge — reprehend Skojec and others for doing this.

Catholics, however, know that to insult others in public is the mortal sin of contumely, and so disdain it. Yes, insult an error or falsehood or behavior, but not a person.

Then there is Rule 11, “If you push a negative hard and deep enough it will break through into its counterside,” by which Alinsky appears to mean that you keep disparaging and misrepresenting your opponent until the opponent thinks he has a problem, or at least the general public does. Clearly the condemnation is not a blanket one. And the distinction I made, which Crazy Uncle Frank glossed over, as he is wont to do, is that the women who write for 1P5 don’t purport to teach anyone. The truth is quite the opposite. As anyone and everyone knows, who reads Ann’s arguments, she always cites reality or Church documents. She never say that anyone should listen to her because she is the source of authority. She is always saying that everyone needs to confront and accept reality, and overcome their inhibitions to live by the teachings and faith of the Church. — Whereas, it is Steve Skojec who is constantly insisting that Catholics ignore Canon Law and the teachings of the Church and Saints as regards the infallibility of the Roman Pontiff and the indefectibility of his person, because some late Scholastic Theologian said something with the word “canonical” in it, but he, Steve Skojec, cancels out that word, and uses the statement as a new rule for discernment against which no teaching of the Church or canon law can be cited, without showing madness or insanity or a schismatic or heretical spirit.

The general attack, used most of all, however, even by pro-Bergoglian apologists, of the kind which Skojec is certainly not, is Rule 3. “Whenever possible go outside the expertise of the enemy.” However, this rule did them in, because little did they know, that there are Catholics out there who are far more capable of understanding Church teaching than they themselves are capable of crafting arguments against it. — Praise be to God!

Reflections

As Catholics we should reject all the methods and lies of Satan. We should likewise reject the methods and lies of all false ideologies, especially Marxism.  When we see any individual or group doing things of this kind in the Church, then we have found a true cancer in the Church, because it does not live by the teachings of Jesus and the examples He has given us, or His Holy Spirit has given in the Saints.

Such individuals objectively are not in communion with the Church, nay, they work against it by striving to kill souls and deceive them. Perhaps they do not know what they are doing, because sin can blind the mind so much as to make it barely capable of discerning its own culpability. But we cannot ignore the fact that by such behavior, whatever persons or groups do such things, they are not in communion with the Church, morally or spiritually speaking, because being in grave mortal sin and working against Her, they have not the life of God in them.

Aiding and abetting such individuals and groups would be a sin of collaboration in the evil they propose. But helping them see their error is a great work of mercy, because it respects them as creatures of God, even if at times they might act like individuals unworthy of the pearls thrown at them.

Nevertheless, a sustained and constant attack by officers of corporations and media outlets against the teaching of the Church on any point must be seen for what it is. Catholics can no longer ignore that the “Recognize and Resist” Movement is at the service of evil in itself, and of even greater evil, inasmuch as it gives power to Bergoglio in sustaining his false claims to be the Pope and to not be a formal, pertinacious heretic.

* In U.S. tax law such an approach is not fraud, if the monies are disbursed as salary for work done on behalf of the non-profit. But Mr. Skojec’s supporters are able to get a tax write-off — if they qualify according to IRS rules for being able to take itemized  deductions — for effectively paying him a salary to write articles for One Peter Five. Unlike, Save Old St. Mary’s Inc., the non-profit which publishes Br. Bugnolo’s books, which has never paid a salary to anyone. And unlike, Ordo Miltiaris Inc., a for-profit, which has never paid a salary to anyone. — Steve does quite well, according to the tax filings for One Peter Five, which show that in 3 recent years alone, his combined earnings in salary were near $500,000 USD. MY LETTER TO CARDINAL RE

In January, it was announced by the Vatican, that Cardinal Giovanni Battista Re was named Dean of the College of Cardinals. Since it it the duty of the Dean to convoke the College, I wrote him a Letter in Latin to express my concerns, in accord with Canon 212, regarding the canonical status of Pope Benedict XVI, in the assumption that he may not be aware of them.

Here is the text of my letter, which he received more than 2 weeks ago:

Sua Eminentia,

Vobis scribo ex iure mihi concesso ab papa Ioanne Paolo II in canone 212, ad Vobis manifestandas inconvenientias graves in declaratione quae emissa est ab papa Benedicto XVI in Festo B. V. M. Lapurdensis anno Domini 2013.

In primis, ministerii eius renuntiatio non est conformans normae canonis 332 §2 qui renuntiationem muneris petrini requirit et hinc est actus nullus qui secundum canonem 41 neminem constringat.

Secundo, nemini licet ut interpres sit actus renuntiationis papalis, et hinc omnis interpretatio actus istius invalida ac illicita esto qui munus legat ubi ministerium scribatur.

Tertio, in dicendo ministerium et non munus vir qui est papa Benedictus XVI actum validum non ponere potest sine concessione derogationis secundum canonem 38 et hinc quia aliquid tale non fecit ut Romanus Pontifex actum irritum posuit ut vir qui est Pontifex.

Quarto, in ministerii renuntiatione et non muneris actus apparens papalis renuntiationis irritus est secundum canonem 188 per errorem substantialem quoniam essentia actus necessaria penes canonem 332 §2 est renuntiatio muneris non ministerii.

Quinto, non est libertas ad muneri renuntiandum quo renuntiatio ministerii fiat et hinc actus talis deficit ex debito canonis 332 §2 ad libere faciendum actum renuntiationis muneris et hinc invalidus est.

Sexto, non est ritualis manifestatio ubi non est manifestatio actus debiti, et quia impossibile est quod actus ministerii renuntiationis manifestet renuntiationem muneris, hinc est invalidus secundum canonem 332 §2. 

Septimo, quoniam aliquot diebus post declarationis enuntiationem actus integer non habebatur, impossibile est quod actus Cardinalis Decani precedentis validus fuit ad renuntiationem papalis annuntiandam secundum normam canonis 40 et postea ad conclavem convocandam.

Octavo, omnes actiones papae Benedicti XVI per septem annos demonstrant quod Is apprehendat munus ut vocationem et gratiam nunquam abiiciendam et non ut ministerium seu officium ecclesiasticum rentuntiatum, et evidens est quod verum sit, quapropter ille nomen et indumentum et dignitatem papalem adhunc portat ut possessionem personalem, qui demonstratio est clare quod intentionem renuntiationis muneris non haberet et non habeat.

Ex totis rationibus ego supplex Vos precor Ecclesiae Sanctae Dei ut convocatio Cardinalium in praesentiae papae Benedicti XV faciatis in tempore opportuno ad verum quaerendum in materia ista ita ut omne dubium de successione petrina tollatis pro Ecclesia Christi salute. Partibus omnibus in ista controversia eliminatio dubii istius ius et debitum est et nulli vulnera.

Here is my English translation of the Letter, for the benefit of the readers of FromRome.Info

Your Eminence,

I am writing you on account of the right granted me by Pope John Paul II in canon 212, to make known to you the grave problems in the Declaratio which was pronounced by Pope Benedict XVI on the Feast of Our Lady of Lourdes, in the year of Our Lord 2013.

First of all, His renunciation of ministry is not in conformity with the norm of Canon 332 §2 which requires the renuntiation of the Petrine Munus, and hence it is an actus nullus which according to canon 41 constrains no one.

Second, it is not licit for anyone to be the interpretor of a papal renunciation, and hence every interpretation of that act of His, which reads “munus” where “ministerium” is written, is invalid and illicit.

Third, in saying “ministerium” and not “munus” the man who is Pope Benedict XVI cannot posit a valid act without the concession of a derogation, according to canon 38, and hence because he never did any such thing, as the Roman Pontiff, he posited, as the man who is the Pontiff, an actus irritus.

Fourth, in renouncing ministry and not munus, the apparent act of papal renunciation is irritus according to canon 188 by means of a substantial error, since the essence of the act necessary under the terms of Canon 332 §2 is a renunciation of munus, not of ministerium.

Fifth, there is no liberty to renounce munus where a renunication of ministerium is made and hence such an act fails from what is due in Canon 332 §2 regarding a free act of renuncaition of munus, and hence is invalid.

Sixth, there is no due manifestation where there is no manifestation of the due act, and because it is impossible that an act of renunciation of ministerium manifest an act of renunciation of munus, hence it is invalid according to Canon 332 §2.

Seventh, since for some days after the pronouncement of the declaration the integral act was not had, it is impossible that the act of the previous Cardinal Dean was valid to announce a papal renunciation, according to the norm of Canon 40 and afterwards to convoke a conclave.

Eighth, all the actions of Pope Benedict XVI throught the last 7 years demonstrate that he understands munus as a vocation and grace never to be rejected and not as a renounced ministerium or ecclesiastical office, and it is evident that this is true, because He bears still that Name and clothing and dignity of a pope as a personal possession, which is clearly a demonstration that he did not have nor has the intention of renouncing the munus.

For all these reasons, I humbly beg you for the sake of the Holy Church of God to call a convocation of the Cardinals in the presence of Pope Benedict XVI, at an opportune time, to seek the truth in this matter so as to bear away all doubt concerning the petrine succession for the sake of the salvation of Christ’s Church. The elimination of this doubt is the right and due to all the parties in this controversy and harms none of them.

Can Popes Teach the Hersey of Communion for Adulterers in their Ordinary Magisterium?

Theologian Fr. J.C. Fenton in an 1946 article for the American Ecclesiastical Review wrote the following:

 – “Under no circumstances can the Supreme Pontiff be in error when he teaches the entire Church on matters of faith.”

–  “The Roman Church as well as the Roman Pontiff is exempt from the possibility of error in faith.”

– “The Roman Pontiff is incapable of error, not only in decrees of faith but also in precepts of morals which are prescribed for the whole Church and which deal with matters necessary to salvation.” (De Romano Pontifice, 1586; Lib. IV, cap. 5, col. 987).

Just as every criminal, for the sake of public safety, should receive a response from the police, so every error merits a refutation by those who love the truth. This is even more true in proportion to the danger posed by the criminal, or by the error.

Backstory

Nearly a year ago, on February 14, 2019, in an attempt to quell the growing realization among many Catholics that Benedict is still the Pope, LifeSite News, a pro-life website founded by a Canandian Political action committee and a converted Atheist, published an article containing a whole string of falsifications of legal principles and straw men arguments, entitled, “Did Benedict really resign? Gänswein, Burke and Brandmüller weigh in.”  The article was authored by Diana Montagna, and it was one of the first to actually mention the controversy over Benedict’s resignation.

I refuted the major points of her article, in my response, published on the same day, entitled, Gänswein, Brandmüller & Burke: Please read Canon 17!

As I look back today at that article, it does not surprise me that it was published at LifeSite News. My experience in apologetics — the one on one discussions with non Catholics to convince them the Catholic Faith is the true Faith or to answer their questions in that regard — for over 24 years has given me plenty of opportunities to speak with atheists of all kinds, and the one difficulty they all have is the inability to believe that words have meaning, and that meaning can carry us to the infinite or eternal. This is one of the great doubts in modern time which is propagated by the secular media and culture, and it is one of the most fundamental attacks Lucifer uses against souls. And as most of us cradle Catholics, who never doubted or left the faith have also experienced, just because a Convert has converted, does not yet mean he has left behind all his faults, errors or phobias.

I say this, because I cannot imagine why any good Catholic would publish an article such as Montagna’s which is so full of lies, and trash the reputation of his 15 year apostolate so profoundly in a single act. Pro-abortionists love to deny the meaning of words, because that is the only way you can kill children in the womb or as they come out of it. Denying Canon Law and legal principles kills souls, and that is a worse crime and sin in the sight of God and faithful Christians.

The Canon 15 §2 Strawman

First, let me thank Fred Martinez over at Catholic Monitor Blog, for drawing my attention again, a year later, to Montagna’s article. Mr. Martinez is doing a superb job at finding and pointing out the logical or textual self-contradictions of the “Bergoglio is certainly the Pope” crowd, and many of his articles show where he catches them saying the exact opposite after 2016 what they said before 2016. — My profound gratitude also to the Most Rev. Rene Henry Gracida, Bishop Emeritus of Corpus Christi, Texas, for reposting his and many of my articles, at his own blog, abyssum.org, to help the wider audience of the faithful know of the pertinent issues in the present Church crisis.

In Montagna’s article, see here, there is trotted out the argument from Canon 15 §2. She quotes the anonymous theologian, thus:

The theologian acknowledged that it is possible that Pope Benedict thought there might be a real distinction between munus and ministerium but was unsure. In that case, he said, Benedict’s abdication would be invalid only if he had in his mind the thought: “I only want to resign the ministerium if it is in fact distinct from the munus.”

But he said it would be equally possible that, being unsure whether there was a distinction, Benedict could have had in mind the thought: “I want to resign the ministerium whether or not it is distinct from the munus.” In that case, the theologian said he believes the resignation would have been valid.

“In any case,” he said, “I don’t think there is convincing evidence that Benedict thought there was a real distinction between the two things.”

“Again,” the theologian continued, “since according to Canon 15.2, error is not presumed about a law, the presumption must be that he validly renounced the papacy.”

Let’s take a look at the actual Canon and see if the anonymous theologian — who appears not to have a degree in Canon Law, because if he did, he should be termed a canonist — actually quoted the Canon correctly and/or represented its authentic meaning:

Canon 15 §2, in the Intratext edition:

Can. 15 – § 1. Ignorantia vel error circa leges irritantes vel inhabilitantes earundem effectum non impediunt, nisi aliud expresse statuatur.

§ 2. Ignorantia vel error circa legem aut poenam aut circa factum proprium aut circa factum alienum notorium non praesumitur; circa factum alienum non notorium praesumitur, donec contrarium probetur.

Which in good English, means:

Canon 15. – § 1. Ignorance and/or error about irritating and/or inabilitating laws* does not impede their effect, unless something else has been expressly established.

§ 2. Ignorance and/or error about a law or punishment or about one’s own deed or about the notorious deed of another is not presumed; it is presumed about the non-notorious fact of another, until the contrary is proven.

But the theologian said Canon 15 §2 says “error is not presumed about a law, the presumption must be that he validly renounced the papacy.” — It is not clear, what the theologian is intending to speak about, because he is quoted to have introduced his statement with, “Again”, which implies reference to a second matter or the use of another kind of argument, or a double reason for the same argument. In charity, I assume he is referring to his straw man argument about the interior state of mind of Pope Benedict.

But it is certain what the canon says regards a person’s ignorance or error regarding a law. That can be seen from the entire context of the Canon, which speaks about a person’s apprehension of facts and of law. But it is proven by the Latin word, circa, which does not mean in, but regarding the matter of.

Thus, if we read the theologian as referring to Benedict’s knowledge of Canon 332 §2, which is the context of Montagna’s article, read in the best possible light, then we can see that the theologian is doing a bate-and-switch, because if we are not to presume that Benedict was ignorant or in error regarding Canon 332 §2, when we must presume that when he renounced ministerium, he did NOT intend to renounce the munus. Because if you think he intended to renounce the munus, then you have presumed he erred in saying ministerium.

As you can see, the anonymous theologian made a gross misrepresentation of the law. If he were a Canonist, I would have to presume in accord with Canon 15 §2 that he was a liar and intentionally misrepresented the canon. But since he is only an anonymous theologian, who  may have never studied Canon Law or may not know how to read Latin, in charity we should presume that he is simply ignorant or incompetent to give his opinion on it. — But, as I demonstrated in my rebuttal 51 weeks ago, everyone quoted in the article shows serious deficiencies in the knowledge of Canon Law or legal principles, except Cardinal Burke who seems to simply mistake the kind of legal matter he is dealing with, just as the great Saint Alphonsus dei Liguori did on the occasion of his conversion to his vocation.

The interpretative principle used by the anonymous theologian seems more adapted to the psycho-analysis of sociopaths, in that a clinical psychologist presumes the context of his patient’s statements in the best possible light but without reference to any objective custom or law of verbal expression, because, after all, he is a patient with problems.

The theologian, therefore, is adopting a presumption and a very uncharitable one toward the reigning Pontiff and towards a man who has read thousands of books. Not to mention, a presumption contrary to fact, because in the previous sentences of the Declaratio, Pope Benedict XVI uses the Latin word “munus” twice!

The correct reading of Canon 15, is that in accord with Canon 15 §1, even if Benedict were ignorant, Canons 38 and 188 and 332 would still nullify his act. So if he did not realize that by renouncing the ministry rather than the munus, he would transgress the essential obligations of Canon 332 §2 in his renunciation as regards the specific act required, the liberty required and the manifestation required, his act would nevertheless BE INVALID!

So Canon 15 destroys entirely the argument of everyone cited in Montagna’s article, because on the one hand if Pope Benedict was ignorant that would not save the act from being nullified by the Law, and if on the other hand we are to presume he was not ignorant, we must understand his act as a renunciation of ministerium, not of munus, and therefore it is also invalid by the same Canons 38, 188 and 332.

Words have meaning: this terrifies atheists and sociopaths, because it demands of each of us that we conform our verbal expression to an objective standard and admit that meaning transcends the categories of human speech, points us towards objective and eternal rules of behavior and implies that there is a God who is Sovereign of this Universe and Who will judge us eternally for what we do and say. — That words have meaning, is also the nemesis of every criminal, because it is through words that he is caught, prosecuted and sentenced.

Thus, we cannot be faithful or upright Catholics if we listen to men or women who attempt to undermine the truth that words have meaning, and if we do not admit that it is not within our power to change their meaning, neither in themselves nor in them when others use them. Those who do such things are practicing the same method of persuasion used by the Serpent in the Garden of Eden, and we all know who that was and what it led to.

* An irritating law is a law which declares a juridical act to have no value in law on account of not having followed the due requirement of the law for the said act. An inabilitating law is a law which deprives the act of the ability to have an effect.  Canon 38 is an inabilitating law, Canon 188 is an irritating law, and Canon 332 § 2 is an invalidating law. Canon 332 §2, is the matter for the application of Canons 38 and 188 in regard to error in a papal renunciation, because as regards the error of a reigning pontiff, the Code takes the position that the administrative act be presumed valid per se but not have the effect others thinks it has or which the pontiff thinks it may have, and thus in canons 38 and 188 and 332, it declares that it has the effect which the sacred canons say it has, and not any other effect. — This is why it is essential, and not simply an optional method of intepretation, that Canon Law be read and used carefully to understand the canonical effect, if any, in an administrative act of the Roman Pontiff.

Coronavirus Infections—More Than Just the Common Cold

Human coronaviruses (HCoVs) have long been considered inconsequential pathogens, causing the “common cold” in otherwise healthy people. However, in the 21st century, 2 highly pathogenic HCoVs—severe acute respiratory syndrome coronavirus (SARS-CoV) and Middle East respiratory syndrome coronavirus (MERS-CoV)—emerged from animal reservoirs to cause global epidemics with alarming morbidity and mortality. In December 2019, yet another pathogenic HCoV, 2019 novel coronavirus (2019-nCoV), was recognized in Wuhan, China, and has caused serious illness and death. The ultimate scope and effect of this outbreak is unclear at present as the situation is rapidly evolving.

Coronaviruses are large, enveloped, positive-strand RNA viruses that can be divided into 4 genera: alpha, beta, delta, and gamma, of which alpha and beta CoVs are known to infect humans.1 Four HCoVs (HCoV 229E, NL63, OC43, and HKU1) are endemic globally and account for 10% to 30% of upper respiratory tract infections in adults. Coronaviruses are ecologically diverse with the greatest variety seen in bats, suggesting that they are the reservoirs for many of these viruses.2 Peridomestic mammals may serve as intermediate hosts, facilitating recombination and mutation events with expansion of genetic diversity. The surface spike (S) glycoprotein is critical for binding of host cell receptors and is believed to represent a key determinant of host range restriction.1

Until recently, HCoVs received relatively little attention due to their mild phenotypes in humans. This changed in 2002, when cases of severe atypical pneumonia were described in Guangdong Province, China, causing worldwide concern as disease spread via international travel to more than 2 dozen countries.2 The new disease became known as severe acute respiratory syndrome (SARS), and a beta-HCoV, named SARS-CoV, was identified as the causative agent. Because early cases shared a history of human-animal contact at live game markets, zoonotic transmission of the virus was strongly suspected.3 Palm civets and raccoon dogs were initially thought to be the animal reservoir(s); however, as more viral sequence data became available, consensus emerged that bats were the natural hosts.

Common symptoms of SARS included fever, cough, dyspnea, and occasionally watery diarrhea.2 Of infected patients, 20% to 30% required mechanical ventilation and 10% died, with higher fatality rates in older patients and those with medical comorbidities. Human-to-human transmission was documented, mostly in health care settings. This nosocomial spread may be explained by basic virology: the predominant human receptor for the SARS S glycoprotein, human angiotensin-converting enzyme 2 (ACE2), is found primarily in the lower respiratory tract, rather than in the upper airway. Receptor distribution may account for both the dearth of upper respiratory tract symptoms and the finding that peak viral shedding occurred late (≈10 days) in illness when individuals were already hospitalized. SARS care often necessitated aerosol-generating procedures such as intubation, which also may have contributed to the prominent nosocomial spread.

Several important transmission events did occur in the community, such as the well-characterized mini-outbreak in the Hotel Metropole in Hong Kong from where infected patrons traveled and spread SARS internationally. Another outbreak occurred at the Amoy Gardens housing complex where more than 300 residents were infected, providing evidence that airborne transmission of SARS-CoV can sometimes occur.4 Nearly 20 years later, the factors associated with transmission of SARS-CoV, ranging from self-limited animal-to-human transmission to human superspreader events, remain poorly understood.

Ultimately, classic public health measures brought the SARS pandemic to an end, but not before 8098 individuals were infected and 774 died.2 The pandemic cost the global economy an estimated $30 billion to $100 billion.1SARS-CoV demonstrated that animal CoVs could jump the species barrier, thereby expanding perception of pandemic threats.

In 2012, another highly pathogenic beta-CoV made the species jump when Middle East respiratory syndrome (MERS) was recognized and MERS-CoV was identified in the sputum of a Saudi man who died from respiratory failure.3 Unlike SARS-CoV, which rapidly spread across the globe and was contained and eliminated in relatively short order, MERS has smoldered, characterized by sporadic zoonotic transmission and limited chains of human spread. MERS-CoV has not yet sustained community spread; instead, it has caused explosive nosocomial transmission events, in some cases linked to a single superspreader, which are devastating for health care systems. According to the World Health Organization (WHO), as of November 2019, MERS-CoV has caused a total of 2494 cases and 858 deaths, the majority in Saudi Arabia. The natural reservoir of MERS-CoV is presumed to be bats, yet human transmission events have primarily been attributed to an intermediate host, the dromedary camel.

MERS shares many clinical features with SARS such as severe atypical pneumonia, yet key differences are evident. Patients with MERS have prominent gastrointestinal symptoms and often acute kidney failure, likely explained by the binding of the MERS-CoV S glycoprotein to dipeptidyl peptidase 4 (DPP4), which is present in the lower airway as well as the gastrointestinal tract and kidney.3 MERS necessitates mechanical ventilation in 50% to 89% of patients and has a case fatality rate of 36%.2

While MERS has not caused the international panic seen with SARS, the emergence of this second, highly pathogenic zoonotic HCoV illustrates the threat posed by this viral family. In 2017, the WHO placed SARS-CoV and MERS-CoV on its Priority Pathogen list, hoping to galvanize research and the development of countermeasures against CoVs.

The action of the WHO proved prescient. On December 31, 2019, Chinese authorities reported a cluster of pneumonia cases in Wuhan, China, most of which included patients who reported exposure to a large seafood market selling many species of live animals. Emergence of another pathogenic zoonotic HCoV was suspected, and by January 10, 2020, researchers from the Shanghai Public Health Clinical Center & School of Public Health and their collaborators released a full genomic sequence of 2019-nCoV to public databases, exemplifying prompt data sharing in outbreak response. Preliminary analyses indicate that 2019-nCoV has some amino acid homology to SARS-CoV and may be able to use ACE2 as a receptor. This has important implications for predicting pandemic potential moving forward. The situation with 2019-nCoV is evolving rapidly, with the case count currently growing into the hundreds. Human-to-human transmission of 2019-nCoV occurs, as evidenced by the infection of 15 health care practitioners in a Wuhan hospital. The extent, if any, to which such transmission might lead to a sustained epidemic remains an open and critical question. So far, it appears that the fatality rate of 2019-nCoV is lower than that of SARS-CoV and MERS-CoV; however, the ultimate scope and effects of the outbreak remain to be seen.

Drawing on experience from prior zoonotic CoV outbreaks, public health authorities have initiated preparedness and response activities. Wuhan leaders closed and disinfected the first identified market. The United States and several other countries have initiated entry screening of passengers from Wuhan at major ports of entry. Health practitioners in other Chinese cities, Thailand, Japan, and South Korea promptly identified travel-related cases, isolating individuals for further care. The first travel-related case in the United States occurred on January 21 in a young Chinese man who had visited Wuhan.

Additionally, biomedical researchers are initiating countermeasure development for 2019-nCoV using SARS-CoV and MERS-CoV as prototypes. For example, platform diagnostic modalities are being rapidly adapted to include 2019-nCoV, allowing early recognition and isolation of cases. Broad-spectrum antivirals, such as remdesivir, an RNA polymerase inhibitor, as well as lopinavir/ritonavir and interferon beta have shown promise against MERS-CoV in animal models and are being assessed for activity against 2019-nCoV.5 Vaccines, which have adapted approaches used for SARS-CoV or MERS-CoV, are also being pursued. For example, scientists at the National Institute of Allergy and Infectious Diseases Vaccine Research Center have used nucleic acid vaccine platform approaches.6 During SARS, researchers moved from obtaining the genomic sequence of SARS-CoV to a phase 1 clinical trial of a DNA vaccine in 20 months and have since compressed that timeline to 3.25 months for other viral diseases. For 2019-nCoV, they hope to move even faster, using messenger RNA (mRNA) vaccine technology. Other researchers are similarly poised to construct viral vectors and subunit vaccines.

While the trajectory of this outbreak is impossible to predict, effective response requires prompt action from the standpoint of classic public health strategies to the timely development and implementation of effective countermeasures. The emergence of yet another outbreak of human disease caused by a pathogen from a viral family formerly thought to be relatively benign underscores the perpetual challenge of emerging infectious diseases and the importance of sustained preparedness

Luke the Evangelist is the patron saint of artists because he paints pictures with words. In describing the scene of old Simeon in the Temple encountering Jesus, Luke wrote that he “took him up in his arms” (Luke 2:28).   That word picture of an old man holding a forty-day-old baby, reminds one of the 1490 painting by the master Domenico Ghirlandaio, of a grandfather and his grandson embracing. The old man is anything but beautiful, save for his smile as he gazes at the angelic boy.

The grandfather’s problematic nose is “warts and all,” as the bleak Oliver Cromwell instructed his own portraitist, Samuel Cooper. For noses, it competes with that of the vaudevillian Jimmy Durante who, incidentally, was married in 1921 in our sister parish of Holy Innocents.  

That juxtaposition of old age and youth bonded by love is the “leitmotif” of the encounter in the Temple. But by what power of perception did Simeon recognize the infant Messiah? You might ask the same of the seventeen-year-old Saint Joan of Arc when she entered the Chateau of Chinon in 1429 and recognized the disguised future King Charles VII.  

Good teachers discern potential in the classroom, like Saint Albert the Great seeing in his student Thomas Aquinas, mocked as a “Dumb Ox,” a future Doctor of the Church. But to discern the Messiah in diapers requires heavenly help, since prodigy is not greater than divinity.  

God comes to us often in obscurity, through unexpected events and persons, rather than through celebrities. Famous people come and go, often through the passing of fashion. In the second century, Plutarch compared the celebrities of his Roman days with the heroes of classical Greece; but who today remembers Cleomenes, whom he matched with Camillus, or Philopoemen compared with Poplicola?  


There are natural intuitions, such as Saint Albert recognizing in the clumsy young Thomas Aquinas the future Doctor of the Church. But Simeon and his accompanying prophetess Anna, like Joan of Arc, had their eyes opened by the Holy Spirit.  

Albert Schweitzer was a hero of my youth and one of the most revered figures of the day. Now he is as remote in present consciousness as Jimmy Durante. He left us an image of the Messiah that Simeon would have understood:

“He comes to us as One unknown, without a name, as of old, by the lakeside, He came to those men who knew Him not. He speaks to us the same words: ‘Follow thou me!’ and sets us to the tasks which He has to fulfill for our time. He commands. And to those who obey Him, whether they be wise or simple, He will reveal himself in the toils, the conflicts, the sufferings which they shall pass through in His fellowship, and, as an ineffable mystery, they shall learn in their own experience Who He is.”
