Dallas County, Texas Salon Owner Jailed For COVID-19 Noncompliance – Opened Business Now Incarcerated…

It doesn’t come as a shock but it is ridiculous in the extreme. A Dallas County Texas salon owner has been sentenced to a week in jail for defying the order to keep her business closed.  “I couldn’t feed my family and my stylists couldn’t feed their families” Ms. Shelly Luther testified.  The court didn’t care.

The stakes are escalating daily as economic desperation takes over and the oppressive hand of the authoritarian government officials refuse to loosen their grip on their new found power over the population.  Confrontation is likely to get much worse quickly.

TEXAS – A Dallas salon owner will spend a week in jail after she was found in contempt of court Tuesday for violating a court order to close her salon during the coronavirus pandemic.

In addition to the jail time, Shelley Luther was fined at least $3,500 for continuing to operate her business, Salon à la Mode, in violation of a temporary restraining order issued against the business.

Like other businesses deemed nonessential, Luther’s Far North Dallas salon was forced to close March 22 after Dallas County enacted its stay-at-home order.  She reopened the salon on April 24 despite that order, and tore up a cease-and-desist letter from Dallas County Judge Clay Jenkins at a demonstration the following day.

Unfortunately we predicted this exact outcome when we were discussing how the Blue regions would line up to destroy the financial livelihoods of people living within oppressive control zones. [Previously Here]  There is a growing likelihood things will continue to escalate as people get increasingly desperate and isolated.

This activity is fuel for a full WACO-style confrontation; which, ultimately would serve the interests of the control authoritarians.  This is not a good trend to be seeing.

The authoritarian government appreciates good citizens who comply with the interests of the state.  Good citizenship is rewarded with access to a safe COVID Compliant Society. A safer society; where the odds will always be in your favor.

A reminder:… During this economic war residents within the Blue occupied territories will be held captive to the political whims of their regional generals.

The economic freedom and liberty zone will encompass the Red region. The center of the country, mid west, southern region (surrounding the Gulf of Mexico) and south eastern Atlantic region. These areas will be open to commerce and economic freedom.

However, the urban dense populations (Blue pockets within Red zones) will push-back against the efforts of the Red generals in an attempt to retain alignment with their Blue team generals. Depending on the strength of the urban forces there may be roadblocks, sabotage, skirmishes and political violence against the freedom & liberty Red team.

If you track the oppression and confrontation you will note it increases in direct proportion to the level of Democrat authoritarian control on a very local level. The higher the spike in the maps below, the greater likelihood your freedom will be removed and you will need to be very careful about any grievance protest.

Red captives within the Blue zones will have to be smart and strategic. Big Blue tech will be assisting the totalitarian Blue generals. Direct confrontation against the Blue forces should be avoided, and it will likely be a better strategy to fight stealthily as insurgents.

Any Red team member of the economic freedom alliance, trapped within a Blue region, is warned to evaluate their connection to their electronic devices. Your cell phones could be used as portable transponders expose your movement and your political views.

As we are seeing, officials within the totalitarian state are not opposed to using full military tactics against U.S. citizens.  This is not new, we have seen this for decades; only this time it is more widespread.  The police firebombed the group MOVE in Philadelphia. Federal officials assassinated members of the Weaver family in Ruby Ridge, Idaho; and everyone is familiar with the WACO Texas massacre.  Those events highlight the potential, only now we are talking about hundreds, perhaps thousands of simultaneous events; again, depending on the level of desperation.

This is going to be one hell of a struggle.  A Spring and Summer conflict looms like we’ve never seen in the history of U.S. politics.  The pressure is building quickly, be careful.

Conduct your affairs accordingly.

    One of the most important tasks of the military governor is to fix the broken voting system by installing safeguards against fraud, like voter ID.
    The most important role of the military governor would be aiding ICE in every way, shape, and form so that when martial law ends, there are NO ILLEGAL ALIENS REMAINING IN THE INSURRECTION STATE.
    It goes without saying that the military governor’s job would include helping the U.S. Marshals Service in capturing and extraditing all communist officials at every level of government in that insurrection state.
    The military’s mission would be similar to that which we rolled out in Japan and Germany at the end of WWII. I can see turning enforcement of Federal statutes over to military justice and military enforcement. But first DJT would have to massively purge the upper ranks of our military establishment of those who climbed the ranks strictly through their ‘lip service’ (multiple meanings there) to the Clinton-Bush-Obama juntas.       Since our Republic was created, by our Bill of Rights and our Constitution, and the, you know, Declaration, thing, all of these documents went thru a consistent test.
      The simple clarification of our Republic, passes thru virtue and conventional morality.
      This passage is the route we must proceed to stay within the frame work of our system of governing. That particular route isn’t straight, smooth nor easy. Pain, death and sadness are unfortunate detours, to our lives as self reliant individual free people. It is an erudite path, where the reward has to be worth the pain. When I sail into the wind, the rum flows a plenty when I reach my end, If we win this battle for our Republic, for which it stands, never forgiving our purpose, for cheap victory. We will leave a stronger map for our future, and a resolve like no other. This is our country, our vote, for our freedom. If we have the best concept of human civilization, we have to prove it works.

Another case of an alarming and screwed up patchwork of “injustice” in the USA. Shelley had obviously taken a firm stand to defend her business and her written rights and isn’t sorry. But according to the authoritarian state’s co-operating Judge, if she lies to him and the Court she will not go to jail. However, he did look disappointed she didn’t capitulate. Whether the Judge was reluctant or not, the $3500 fine in addition to the week in jail is a travesty of injustice for a struggling small business owner trying to save her business with “voluntary” customers willing to go her shop. She wasn’t forcing anyone to walk into her Salon. This is a despicable and outrageous punishment. Two qualities that can easily lead to a more serious encounter as sundance noted. Especially, if businesses like this are ruined by the inconsistent policies of state authoritarians and can not restart due to bankruptcy. Cooler heads like Gov. Are the Virus Cops just an Outgrowth of the Abortion Cops with their Bishop Accomplices except for Bp. Gracida?

All Catholic moral theologians have taught that one of the ways of making oneself an accomplice to a crime is to remove an obstacle that one knows is preventing the crime.

Only one–ONE–Catholic bishop instructed the police that removing people who were obstacles to abortions is to make oneself an accomplice to abortions. He gave the police in his diocese letters to give to their superiors, declaring that obedience to orders to carry out such arrests would be a crime, and a mortal sin, and therefore an impossibility for any cop–Catholic or not.

That bishop was René Gracida.

James Hickey, Cardinal Archbishop of Washington, was typical. Absolute silence, for years on end, as the police committed murder after murder under his nose. Learning at Hickey’s feet how to be a bishop was Fr. William Lori.

John May, Archbishop of St. Louis, held multiple televised press conferences over a period of years, declaring that “the police have to enforce the law, no matter what it is.” He condemned the rescuers on many occasions.

Most Americans still believe that American cops are fundamentally different from those terrible Germans who gave their government blind obedience.

Within a week it was revealed that 13 residents of that nursing home had died from the virus and others had exhibited symptoms related to the disease.In New York, “Steuben County officials said about 73% of the county’s 33 confirmed deaths related to the coronavirus have been linked to nursing homes.”And the grim facts relating to nursing home residents only get worse. In New Jersey, police discovered 17 bodies piled in a small morgue in the “Andover Subacute and Rehabilitation Center I and II, the state’s largest licensed facility.”The news in Philadelphia is much the same. Calling nursing homes “tinder boxes,” a report explores how the virus “swept” through the city’s nursing homes: “At least nine Philadelphia nursing homes had 50 or more cases by then. As of Saturday, 374 nursing home residents have died of the virus, accounting for more than half of Philadelphia’s COVID-19 deaths.” This story, like so many others we have seen, tells a gruesome tale that is not readily explained if one depends on national mainstream media. A Philadelphia Inquirer reporter explains that “an analysis of the Philadelphia data shows that the worst 10 homes for rate of infections, based on number of beds, were all rated one star (‘much below average’) to three stars (‘average’) on the federal government’s five-star rating system.”Why do so many nursing facilities in our country have such low ratings? What is the real problem, and how do we fix it?Perhaps we should look beyond the “rating system” and ask questions about how advance directives are used in nursing facilities, especially in the age of COVID-19. Paul Byrne, MD, who is an expert on such matters, provides an outstanding analysis of that point. He writes about the trail to imposed death that is paved with years of promoting false definitions of death, living wills, advance directives, palliative care, and decisions to put old folks out of their misery instead of treating them with dignity and respect. He accurate explains:Nursing home residents, relatives and friends are affected by the involuntary mandated imposition of no visitors. If a person, labeled a “client,” in a nursing home has an acute illness, they are subject to whatever is provided. Their Advance Directive is in place for non-treatment, even for unspecified imaginable illnesses. Many are frail; they are without relatives; treatment depends on whatever personnel in the nursing home provide. Their Advance Directive indicates that the person has chosen not to receive some treatments; thus, it is so easy to translate this into no treatment.Dr. Byrne’s warning rings loudly, especially as we read about the decision California’s governor, Gavin Newsom, is facing right now. Apparently he is considering signing an executive order requested by “top officials from six healthcare groups” that would provide immunity to people who own nursing homes or who work in them should criminal prosecution or civil lawsuits occur because of the pandemic!Talk about a veil of silence! Are those officials preparing to shirk their duties? Do they want protection because killing is going on? Some have said the pandemic demands that institutions take extreme measures. But we say no, not so fast. Regardless of the perilous times, every human being deserves our best care and our loving support, not imposed death that lurks behind the veil of silence.Be prepared. Since Rousseau there has been promoted in the West a very pernicious error, which has long ago spread to the entire world, namely that we are born just and innocent and good.

The truth rather is found only in the Catholic Faith — capital, F, here to indicate the doctrines of the Holy Roman Church — which make the proper distinctions, distinctions which every man needs to know if he is to save his soul and arrive at eternal life.

Yes, all God has made is good according to its nature, form, being and existence. This include human nature and all human beings. And inasmuch as man is good according to his nature, form, being and existence, God commands the human race to be fruitful and multiply. This regards the natural order.

But moral goodness is a measure of the quality of the will in a rational creature in that will’s conformity to willing what is good, and not just what appears to be good, but what is truly good. Thus we speak of some men who are good and some who are evil, because we speak of how their wills are aligned to good or evil. This regards the moral order.

But the moral order, since it can regard things which are held in the human will, which is a spiritual faculty, is part of the spiritual order. And this spiritual order, inasmuch as it regards spiritual truth or spiritual falsehoods can also be called good or evil.

So Rousseau is correct when speaking of the natural order, and of the moral order of the human person in the womb, or before the use of reason, because not only is a man good according to his nature, form, being and existence, his will is naturally inclined to seek the good.

However, Rousseau is wrong because he denies the spiritual order.

For the truth is, that though we are conceived in a Creation from God which God Himself calls good, and though He calls our nature, very good, nevertheless, we are conceived into Hell.

This is because, on account of the sin of Adam, our race was cast down into subjection to the Father of Lies, Lucifer, the great deceiver, when Adam listened to his deceived wife, Eve, and spurned the will of God and the punishments which God had decreed for the violation of His precept regarding the Tree of the Knowledge of Good and Evil.

According to the Saints, this was a real Tree, but it also represented a concrete test of Adam and Evil in the spiritual order. By choosing to follow the counsel of Satan, they rejected the supernatural order of grace, in which God had created them, and chose the infernal order of damnation to which the Devil seduced them.

From that point onward, all human beings have been conceived into this same spiritual state. In the Catholic Faith, we call this the state of Original Sin. Here the word, “state”, means status, not a nation.

But few of us consider how horrible this truth is, namely, that we are conceived into Hell, that is, conceived in Original Sin, and into subjection to all the demons of Hell.

This state is not one of possession, because we retain the natural liberty of free will and the natural capacity to exercise that will at all times. (A possessed person retains the former, but not the latter at all times).

We Catholics too often dismiss this horror and horrible state by a misunderstanding of the effects of Baptism. Because we do rightly to rush our newborns to the Font of Salvation and have them delivered by the grace of the Sacrament of Baptism (which in the Old Rite rightly includes several exorcisms) and freed from the stain of Original Sin, justified by Sanctifying Grace and infused with all the theological and moral virtues.

And this motivation and faith is good and true, because there is no hope for man apart from Baptism into Jesus Christ, that is into His Mystical Body, the Catholic Church.

However, there is nearly always forgotten in modern times, that Baptism sanctifies the soul and restores the spiritual order in it, BUT IT DOES  NOT alter the human body, which remains, on account of its conception in original sin, disposed to return to the slavery of the devil.

The grave failure in modern times to attend to this truth of the human body has led to countless horrors, sins and abominations.

This truth of the de facto subjection of the human body to the empire of the devil means, that in its quasi-natural tendencies, our flesh will always incline to sin, vice and disorder.

The Saints teach us this, because they were such examples of fasting, mortification, penances, patience and heroic self punishments. Though they were very holy in soul, they nevertheless did not ignore that their flesh was corrupted in its very conception and that to live in accord with God’s Will it was absolutely necessary that they not only subject it to God’s teaching but that they discipline it, and refuse to follow its inclinations.

This is something we need to remember when judging ourselves.

For we should not presume we are without sin. We should not presume we are properly disposed to receive the Sacraments. We should not presume that our first inclinations or natural states of mind or intention are good.

Rather, we should presume the contrary, have a great circumspection about ourselves.

Even the pagan philosopher, Aristotle, realized this, when he wrote that nearly no man is able to think properly until he is at least 50 years of age, on account of the force of the disordered affections which subject men to the vices of lust, avarice and the desire for power.

The same is true for us as Catholics, though we are baptized, and even when we are in the state of grace. Because the state of grace is no guarantee that our first movements are not disordered.  It is a force that they be properly ordered, but unless we live the life of grace by acts of faith, hope, charity, and mortification and self discipline, these first movements might be quite otherwise.  Only in the great Saints, who were so faithful, that God granted them to pass through a special kind of spiritual purgation, can we say their first inclinations were always spiritually good or at least not evil.

So to sum up, remember that your were conceived into Hell, redeemed by Christ in Baptism, but that your flesh remains inclined to return to the slavery of the Devil, and that, so long as you live, you need to fight against its inclinations to evil.

With this knowledge, discerning the spirit of Christ and the Spirit of the Antichrist is easy:

Christ says: Deny yourself, take up your Cross, and follow Me.

The AntiChrist says:  Affirm yourself, be free, and do as you will.

    I send this text with all its imperfections simply because I wish you to see it  . Even should you wish to publish it we must have clear evidence that Bergoglio uttered these words in a public  forum . Please accept my prayers . With kind regards , Maire .

      I am about to copy an extract published by Vox Cantoris from what he states is a homily delivered by Bergoglio on 4 May . Vox strikes me as an excitable writer , well meaning , but not always careful as to the authenticity of the material he handles . He cites no source for the extract , nevertheless it may be authentic . I send it for this reason . It is exactly what I should expect Bergoglio to say if he were for once honestly declaring the insane bases of his beliefs . If I be correct he believes in  a   God who could neither create nor redeem us since he is wholly unaware of his own identity . As might be supposed , he is a  ‘’God ‘’ endowed with so small a smattering of love for us that he is entirely content  to leave us in our blindness and sin so that we are never happy , here , or in the world to come . That vital change so rightly emphasized by both Augustine and Newman as the work of redemption and salvation  will never come to pass with such a God . I suspected some years ago that Bergoglio did not believe in original sin , nor indeed in actual sin in any meaningful sense . He believes only in such sins as he determines for us in one of his pseudo-.. theological ramblings . In short he is not in any sense a Christian. The passage follows :-

        ‘’ The Lord died for us all . And also for people who do not believe in Him or are of other religions: he died for everyone . That does not mean that proselytism must be done  : no. But  He died for everyone . He justified everyone .’’

[ I have copied it , I hope , exactly .] You will have noted that while the first statements  are true what follows is entirely idiosyncratic [ if not indeed the words of an utter fool for they have no foundation other than Bergoglio’s private opinions . But , soft , indeed soft . these are the ‘’Vote Catchers ‘’ . Many people like to hear cuddly nonsense and  to have their minds fixed on the  world , Bergoglio’s world of comfortable mock humanism . A world of total  Bergoglian  unreality is so much more attractive  , than the realization that for all the wonders and beauties of a fallen world , it is indeed fallen , and very often abominably so , and  the Christian’s Homeland cannot possibly be here . Some allege that Bergolio is well-read in Sacred Scripture . Perhaps so . If so he has an amazing capacity  to forget all and any word of the Divine and Incarnate Word , whose Vicar it is also alleged that he is , whenever  its memory would obstruct his ramblings . The solemn warnings of Matthew’s seventh chapter do not , it seems , impede the free expression of opinions by him  who was appointed to feed Christ’s sheep and lambs [ Christ’s we note , and only Christ’s ] . Neither does he observe that an evil  tree cannot bear good fruit . [ Matth. 7: 18 ]  H e ignores that most solemn Divine Word, ibid  in both senses , on the active heart of justification , and for that matter on Petrinity , on being Christ’s true Vicar :-

         ‘’ Non omnis qui dicit mihi , Domine , Domine  , intrabit in regnum caelorum ; sed qui facit voluntatem Patris mei ,qui in caelis est , ipse intrabit in regnum caelorum . [  ibid. : 21 ]

The most remarkable  aspect of the blindness of pseudo-petrinity spinning recklessly on its  own fulcrum is found   in this .  Christ  neither gave nor could give the divine prerogative of knowing who is justified  and of exercising the consequent judgement of his limitless wisdom and righteousness to any mortal .  With his assertion that Christ justified everyone by his death  Bergoglio blatantly contradicts his supposed Master.All things are consigned by the Father into that Master’s hands until that day identified by Saint Paul as the day of their  re-capitulation  , their re-heading , in Christ . { Ephes. 1:10 ]  . In the interval preceding that fulfilment of the Divine Plan  it  is Christ who alone is the Gate of the sheep .[ John 10 : 7 ] He judges his sheep , those who are baptized into his death and resurrection , by what Faith fulfilled in Charity they have exhibited in this world to the Blessed Trinity whom he as Divine Word Incarnate revealed . What is more , in the sheepfold to come , and even in measure in its earthly precursor , Christ’s Church , his sheep are happy. They come and go who enter through him and find pasture . [ cf. Ibid ;9]

They  rejoice in the society of the Good Shepherd who has surrendered his life for them . [ cf. Ibid : 11 ] . They rejoice in him whom they know and to whom they are known . [ cf. Ibid : 14 ] They rejoice in him , true God and true Man , through whom alone grace and truth have been given. [Ibid. 1 : 17 ] and knowledge of the Father that none but the Only Begotten God could reveal .[ ibid : 18 , NA 28 monogenes Theos ]

     Justification , the foundation of Christian profession , is offered to all . It can only be accepted by the Father’s gift of Faith , a gift that should sustain every member of Christ’s Church from the highest to the most lowly . It is a gift that hitherto has prompted obedience to Christ’s final and Great Commission . [ Matth. 28 : 18-20 ] When will those authorized to guide and govern Christ’s Church accept that she cannot have two master’s . He who teaches the universality of unconditional justification is the enemy of him to whom all power in Heaven and Earth have been given . ibid. 18 ] If Athanasius dare not rise will not an eye on the main chance beyond all conceivable opportunities not at least provoke ‘’ Il ne passera pas .’’

How is the government to decide what meetings are “essential”?

Yesterday, a per curiam Sixth Circuit panel (Sutton, McKeague, and Nalbandian) decided Maryville Baptist Church v. Beshear. (Eugene blogged about it earlier.) This decision halted the Kentucky governor’s prohibition on “drive-in” church services. The Governor’s policy, the court found, violates the Kentucky Religious Freedom Restoration Act and the Free Exercise Clause. I commend this opinion on several levels.

First, the decision approaches this difficult issue with the sobriety and respect it deserves. There was no hyperbolic rhetoric or accusations of bad faith. Indeed, the Court credited the Governor with the presumption of regularity:

We don’t doubt the Governor’s sincerity in trying to do his level best to lessen the spread of the virus or his authority to protect the Commonwealth’s citizens.

The panel found that the Governor was doing his best to prevent the spread of an unprecedented epidemic.

Second, the court only decided issues that it needed to resolve. Specifically, it declined to resolve the validity of the in-person service ban:

The balance is more difficult when it comes to in-person services. Allowance for drive-in services this Sunday mitigates some harm to the congregants and the Church. In view of the fastmoving pace of this litigation and in view of the lack of additional input from the district court, whether of a fact-finding dimension or not, we are inclined not to extend the injunction to inperson services at this point. We realize that this falls short of everything the Church has asked for and much of what it wants. But that is all we are comfortable doing after the 24 hours the plaintiffs have given us with this case. In the near term, we urge the district court to prioritize resolution of the claims in view of the looming May 20 date and for the Governor and plaintiffs to consider acceptable alternatives. The breadth of the ban on religious services, together with a haven for numerous secular exceptions, should give pause to anyone who prizes religious freedom. But it’s not always easy to decide what is Caesar’s and what is God’s—and that’s assuredly true in the context of a pandemic.

The last sentence had a subtle, but effective reference to religion.

Third, the decision provides reasoned consideration that people of all persuasions and faiths can relate to. Consider this passage:

The Governor insists at the outset that there are “no exceptions at all.” Appellee Br. at 21. But that is word play. The orders allow “life-sustaining” operations and don’t include worship services in that definition. And many of the serial exemptions for secular activities pose comparable public health risks to worship services. For example: The exception for “life-sustaining” businesses allows law firms, laundromats, liquor stores, and gun shops to continue to operate so long as they follow social-distancing and other health-related precautions. R. 1-7 at 2–6. But the orders do not permit soul-sustaining group services of faith organizations, even if the groups adhere to all the public health guidelines required of essential services and even when they meet outdoors.

The contrast between “life-sustaining” and “soul-sustaining” is poetic and persuasive. This crystal-clear prose explains with precision why the government’s policy is internally inconsistent. (Though the unsigned decision is per curiam, I would bet anyone a buckeye this language came from Judge Sutton’s chambers). Why can some people meet in groups with social distancing, but not others? The government must make a subjective judgment about what is “essential” and what is not. For example, the Pennsylvania Governor determined that making marshmallow peeps was “life-sustaining” but selling firearms was not. The Sixth Circuit tears apart Kentucky’s policy:

Assuming all of the same precautions are taken, why is it safe to wait in a car for a liquor store to open but dangerous to wait in a car to hear morning prayers? Why can someone safely walk down a grocery store aisle but not a pew? And why can someone safely interact with a brave delivery woman but not with a stoic minister? The Commonwealth has no good answers. While the law may take periodic naps during a pandemic, we will not let it sleep through one.

And why does the state trust some professions, but not the clergy to practice social distancing?

Keep in mind that the Church and Dr. Roberts do not seek to insulate themselves from the Commonwealth’s general public health guidelines. They simply wish to incorporate them into their worship services. They are willing to practice social distancing. They are willing to follow any hygiene requirements. They are not asking to share a chalice. The Governor has offered no good reason so far for refusing to trust the congregants who promise to use care in worship in just the same way it trusts accountants, lawyers, and laundromat workers to do the same. If any group fails, as assuredly some groups have failed in the past, the Governor is free to enforce the social distancing rules against them for that reason.

Moreover, the state cannot dictate alternatives that the house of worship can adopt.

Sure, the Church might use Zoom services or the like, as so many places of worship have decided to do over the last two months. But who is to say that every member of the congregation has access to the necessary technology to make that work? Or to say that every member of the congregation must see it as an adequate substitute for what it means when “two or three gather in my Name.” Matthew 18:20; see also On Fire Christian Ctr., Inc. v. Fischer, No. 3:20-CV-264- JRW, 2020 WL 1820249, at *7–8 (W.D. Ky. Apr. 11, 2020).

Not all faiths can use Zoom. Certain Jewish groups will not use electricity during the Sabbath and other holidays. It is simply impossible for them to live-stream a Passover seder or the Kol Nidre service during Yom Kippur. And there are some rituals that can only be performed with a quorum of ten, know as a minyan.

Marc DeGirolami provides the Catholic perspective at Mirror of Justice:

Consider religious observance. If one’s view is that all of the true goods of religious observance can be obtained individually, at home, in solitary prayer in front of a screen, then one will think that distinguishing between churches and liquor stores–treating the goods of the human activities that these places foster unequally–is perfectly justified. But if one’s view of the true goods of religious observance is very different, then one will not accept these arguments.

Marc also draws attention to a jarring video from Italy. A police officers interrupts a mass, and tells the priest to stop the service, and disperse his parishioners. At the time, there were 14 people, who were spaced out in a huge church. Marc relates that the government had planned to re-opened certain businesses, including museums. But not churches.

The dialogue is in Italian, but you can follow along. The priest tells the officer, “All right, I’ll pay the fine, or whatever there is to pay.” The officer says people can watch the live-stream. The priest replies that his parishioners cannot receive communion online.

Zoom may be an answer to online education. But it is not a replacement for deeply held religious practices. Thankfully, laws like RFRA ensure that the government cannot substantially burden free exercise, even if it acts with purported neutrality. I hedge, slightly, because often a policy of neutrality is premised on a secular understanding of what is “life-sustaining” and what is “soul-sustaining.” For many Americans, what is “soul-sustaining” is “life-sustaining.” A house of worship is far more essential than a liquor store.

The remarkable Thomas Reid, the Scot philosopher who graced the end of the 18thCentury, noted that philosophers will often find “great difficulties about a thing which, to the rest of mankind, seems perfectly clear.”

David Hume may have found something inscrutable about the meaning of “causation,” but the ordinary man knows his own powers to cause his own acts to happen.  As Reid had it, that was part of the common sense that precedes all theories. And some of us find the ground of Natural Law precisely in those axioms of common sense.

But we find maxims in our public life that are treated often as though they were sage principles that may truly settle the moral questions in our lives, and yet any serious reflection would reveal them as quite empty.

It would be hard to exaggerate the effect on our public life of that sentiment, waxed in many forms, but set down by John Stuart Mill, in his over-cited little book, On Liberty:  that the law should not impose restrictions on liberty “when a person’s conduct affects the interests of no person besides himself.”   That line became the hallmark of the libertarians, from the censoring of books and pornography to the tolerance, and then the celebration, of the homosexual life.

Surely, it can be found in Justice Kennedy’s glorifying of “autonomy” – that grand insulation from the adverse judgments of others, as same-sex couples pursue, without reproach, their sexual lives and their claim to consummate marriages.

Any parent will know teenagers drawn to jolting new habits and passions, and the fact that the son is pleased enough with his mode of conduct is not taken as the proof of its rightness.

But even when it comes to grownups, common sense will break through.  The laws came to bar dueling, even as that pastime enjoyed the consent of the two parties. And the Supreme Court, in 1911, refused to uphold the freedom of people to contract themselves into a state of peonage or slavery.

If there was something wrong in principle with ruling other men as a species of property, that wrongness would not be effaced by the fact that a man assented.  We still have the term, while the deeper meaning has faded: “unalienable rights” – rights so necessary and true that we were not free to “alienate” or forego them.

Libertarians were content to soar with Mill’s lines, but they usually didn’t notice how quickly the urbane Mill could modify and take them back. And so he asked, “How . . . can any part of the conduct of a member of society be a matter of indifference to the other members?  No person is an entirely isolated being;  it is impossible for a person to do anything seriously or permanently hurtful to himself, without mischief reaching at least to his near connections, and often beyond them.”

But for me, the most arresting critique of this liberal slogan, masquerading as a principle, came from that gentle and steely soul, Cardinal Jean-Marie Lustiger (1926-2007).  He was the French Jewish child, hidden during World War II, who entered the Church and rose to become the Archbishop of Paris.

Fr. Richard Neuhaus invited him to New York in 1996 to join one of our seminars under the auspices of the Institute of Religion and Public Life and to give our Erasmus Lecture.  His subject was “Liberty, Equality and Fraternity,” with the terms seen in a strikingly different way when viewed with the Christian understanding of “the human person.”

When he dealt with liberty,  he recalled that venerable line, sprung from Mill, that our freedom found its limits only as soon as we began to affect other people in an adverse or injurious way.  Lustiger then asked a question I’d never heard:  Did that line refer to the way we might affect “all other” people?   Even people we don’t know?  People who may be, for all we know, men of doubtful character, who don’t deserve any heartfelt concern on our part?   Hmm.

Might we be tempted to rephrase the maxim in this way:  that my freedom ends where I began to affect in harmful ways – wink, wink – those who count.  When Bill Clinton vetoed the federal bill on partial-birth abortion, he expressed concern for the “health” of the woman who was denied that surgery.  But for the child whose head was being punctured, with the contents drawn out, he expressed no interest. That child simply didn’t count in the ingredients that made up the case for him.

With the Christian perspective, that child was never out of sight, for the simple reason expressed by Lincoln:  that “nothing stamped with the Divine image and likeness was sent into the world to be trodden on, and degraded, and imbruted,” and regarded as of no account at all.

Mill’s line has fed for years the surety of the “college-educated” that there are no moral truths.  And yet, the irony, as the Cardinal showed, was that Mill’s familiar maxim made little sense unless it backed into that deep moral truth that underlay the American regime:  “all men are created equal.”

That people keep backing into that proposition, while seeking to deny it, may remind us that it really does have the properties of a “self-evident” or necessary truth.   The Cardinal’s point, from twenty-four years ago, would still bring news to the liberals, and perhaps even comfort, if they ever come to hear it.© 2020 The Catholic Thing. There is only one reliable metric that reveals how likely you are to die from COVID-19 in a given state, and it isn’t what you’re seeing in the legacy media. The number of new cases and deaths, for example, are staples of news stories about the pandemic. Neither of these factoids, however, tells us very much in the absence of sophisticated epidemiological data that just isn’t yet available. A far more predictive metric is “death rate per million.” Why? Testing is far more consistent for fatal cases. By this measurement, you are probably more likely to die from coronavirus if you live in a blue state rather than one of its scarlet counterparts.

If you live in New Jersey, you are 13 times more likely to die from COVID-19 than if you live in Florida. The Garden State’s death rate per million is 895.2, according to the RealClearPolitics coronavirus tracker, compared to only 65.1 deaths per million for Florida. This disparity can’t be written off to demography or testing. Florida has a huge elderly population, and it has conducted twice as many tests as New Jersey. Finally, Florida Gov. Ron DeSantis resisted the draconian stay-at-home orders imposed by his Democratic counterpart in New Jersey and hasn’t been afraid to point out that he was right:

You look at some of the most draconian orders that have been issued in some of these states and compare Florida in terms of our hospitalizations per 100,000, in terms of our fatalities per 100,000. I mean you go from D.C., Maryland, New Jersey, New York, Connecticut, Massachusetts, Michigan.… We had a tailored and measured approach that not only helped our numbers be way below what anyone predicted but also did less damage to our state going forward.

Gov. DeSantis was right to resist, and he is already in the process of reopening the state. Meanwhile, New Jersey Gov. Phil Murphy has extended his stay-at-home order indefinitely. Why, then, are the states that DeSantis named extending their lockdowns? Is the New Jersey–Florida comparison an outlier? Nope. In fact, the red states that refused to issue any stay-at-home orders at all have experienced even fewer coronavirus deaths per million than Florida: Arkansas (26.5), Iowa (59.6), Oklahoma (60.1), Nebraska (40.3), Utah (15.6), North Dakota (32.8), South Dakota (23.7), and Wyoming (12.1).

Does all this sound and fury prove that your chance of dying from COVID-19 is higher if you live in a blue state? 

How have the blue states that DeSantis singled out above fared? Not so well. The District of Columbia has a death rate per million of 365.6. Maryland’s fatality per million is 217.8. New Jersey, as discussed above, clocks in at 895.2 per million. New York is by far the worst in the nation with a fatality rate of 1,282.2 per million. Connecticut has a death rate per million of 716.9. Massachusetts is at 588.5 deaths per million. And there is Michigan, of course, where Gov. Gretchen Whitmer’s lockdown has produced a death rate of 414.0 per million. To maintain this impressive showing she defied the legislature:

Whitmer used one executive order to terminate Michigan’s current state of emergency, which was set to expire Thursday night [April 30], and cited two emergency powers laws, one from 1945 and another from 1976, as the legal basis for unilaterally extending the state of emergency.… Whitmer also signed an executive order keeping bars, gyms, casinos and theaters closed and only allowing restaurants to do delivery or takeout service through May 28.

It isn’t difficult to see why Michigan’s Capitol building has been the scene of at least three voter protests during the past month and why both the Michigan House and Senate passed resolutions giving their leaders power to take legal action against Whitmer over her antics. Moreover, Michigan Congressman Paul Mitchell filed a federal lawsuit against Whitmer on Monday: “Mitchell argues the Governor’s declaration of a state of emergency without legislative approval and her use of executive orders violate Article IV, Section 4 as well as the 14th Amendment to the Constitution.”

Does all this sound and fury prove that your chance of dying from COVID-19 is higher if you live in a blue state? It certainly qualifies as circumstantial evidence. But if you prefer your stats to be less anecdotal, the following assumption may be useful: At present, there are 26 states with Republican governors, 24 states with Democratic governors, and D.C. This is an imperfect breakdown of red and blue states, of course. For purposes of this discussion, however, we will assume “conservative” Democratic governors in red states cancel out “RINO” governors in blue states. That leaves us with the following.

In our 26 red states, the average coronavirus death rate per million is about 82. In the 24 blue states, plus the District of Columbia, it’s about 235. On average, then, you are about 2.9 times more likely to die of COVID-19 if you live a blue state than if you live in a red state. But averages mean little in the real world. If you live in New York, your chance of dying of coronavirus is 11 times higher than if you live in Georgia. The numbers change depending on the relative states, of course, but the most predictive factor is whether you prefer blue or red. The former preference appears to be bad for your health.
